(e) by inserting after the number 3 in the Second Schedule the heading “Covenants in Respect of Rights of Way Easements and Parking Easement”; and

(f) by inserting after clause 3 (b) in the Second Schedule the following clause 3 (c):

“(c) shall be responsible for the construction, maintenance and repair of the land thirdly described in the First Schedule to the reasonable satisfaction of the grantee”; and

(g) by inserting after the said clause 3 (c) in the Second Schedule the following clause 3 (d):

“(d) and the grantee mutually covenant that the land thirdly described in the First Schedule shall not be restricted in any way or for any time except for reasonable time limits (e.g. 60 minute parking) for the use by the public enjoying either the public or private facilities of the area at any time of the day or night unless for reasons of security it is mutually agreed between the grantor and the grantee that there is a need to close the land thirdly described in the First Schedule during the specified times”; and

(h) by inserting in paragraph 4 of the Second Schedule after the words “clause 3” the words “or clause 3 (c)”.

Road Realignment in the District of Southland—Dipton Castlerock Road

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, Kerry John Twydle, Land Information New Zealand, declares the land described in the Schedule to this notice to be road and vested in the Southland District Council.

Road Realignment in the District of Southland—Nokomai

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand:

(a) Pursuant to section 114 (1), declares, agreements to that effect having been entered into, the land described in the First Schedule hereto, to be road and vested in the Southland District Council on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to sections 116 and 117, declares the portions of road described in the Second Schedule hereto, to be stopped and amalgamated with the land in certificate of title 10A/335, subject to existing encumbrances.

(c) Pursuant to section 119, declares the land described in the Third Schedule hereto, to be taken, and declares that:

(i) The land firstly to seventeenthly described (both inclusive) be amalgamated with the land in certificate of title 10A/335, subject to existing encumbrances.

(ii) The land eighteenthly to twenty-fourthly described (both inclusive) shall be added to the adjoining Crown land reserved from sale [marginal strip].

(iii) Pursuant to section 52 of the Public Work Act 1981, the land twenty-fifthly and twenty-sixthly described shall be set apart as Crown land and vested in the Minister of Lands as part of the bed of the Nokomai River.
