The Traffic (Western Bay of Plenty District) Notice 2000

Pursuant to section 52 of the Transport Act 1962 and Regulation 21 (2) of the Traffic Regulations 1976, and pursuant to an authority sub-delegated to me by the Land Transport Safety Authority of New Zealand dated 9 June 1997, I, John Paul Edgar, Manager, Safer Roads, give the following notice:

Notice

  1. This notice may be cited as the Traffic (Western Bay of Plenty District) Notice 2000.

  2. Those localities and roads within markings identified in the legend of and appearing on the plan numbered LT 0025/1, entitled “Western Bay of Plenty District Roading Speed Restrictions at Waihi Beach and Athenree”, and held by the Head Office of the Land Transport Safety Authority, are declared to be closely populated localities at all times, pursuant to section 52 (1) (c) of the Transport Act 1962; except where declared:
    (a) as 70 kilometres an hour speed limit areas, pursuant to Regulation 21 (2) of the Traffic Regulations 1976; or
    (b) excluded from the limitation as to speed imposed by section 52 (1) of the Transport Act 1962, and pursuant to section 52 (2) of that Act
    as may be ascertained from the legend. The plan and legend are hereby incorporated into this notice.

  3. The Traffic (Western Bay of Plenty District) Notice 1998 is revoked.

Schedule 2

Conditions

(i) This exemption applies only to vehicles operated in accordance with the code of practice agreed between Motor Safe (NZ) Limited and the Director of Land Transport Safety.

(ii) This exemption may be revoked at any time.

(iii) A copy of this notice must be carried by the operator of the vehicle and must be readily available for inspection.

Notice of Approval to Act as a Statutory Supervisor Under Section 48 of the Securities Act 1978

Pursuant to section 48 of the Securities Act 1978, the Securities Commission approves BDO Auckland Trustee Company Limited to act as a statutory supervisor for the purposes of the Securities Act 1978 in respect of participatory securities to be offered to the public for subscription by WorldWide Resorts (New Zealand) Limited (“WorldWide”), for a period of 5 years from the day after the date of this notification in the New Zealand Gazette, or until earlier revoked by the Securities Commission.

The approval is given subject to the following conditions:

(a) That neither BDO Auckland Trustee Company Limited nor any shareholder, director, officer or employee of BDO Auckland Trustee Company Limited is at any time a shareholder of WorldWide;

(b) That BDO Auckland Trustee Company Limited does not at any time hold any office or appointment (including appointment as auditor) in respect of WorldWide or any manager of the scheme;

(c) That BDO Auckland Trustee Company Limited does not at any time control or have the right to control, directly or indirectly, WorldWide or any manager of the scheme otherwise than in connection with the performance of its functions and powers as statutory supervisor;

(d) That BDO Auckland Trustee Company Limited does not at any time hold any participatory securities issued by WorldWide or any manager of the scheme;

(e) That no relationship exists at any time between BDO Auckland Trustee Company Limited and WorldWide, or any manager of the scheme, that affects, or is likely to affect, the ability of BDO Auckland Trustee Company Limited to perform its functions and powers as statutory supervisor;

(f) That BDO Auckland Trustee Company Limited maintains professional indemnity insurance in respect of the exercise of its functions and powers as statutory supervisor;

(g) That no relationship exists at any time between BDO Auckland, BDO Waikato or BDO Hogg Young Cathie, Chartered Accountants, nor any of their employees or partners, and WorldWide, or any manager of the scheme.

Exemption From Specified Requirements of the Traffic Regulations 1976 and the Transport (Vehicle Standards) Regulations 1990

Pursuant to Regulation 90 (1) of the Traffic Regulations 1976, and pursuant to Regulation 36 of the Transport (Vehicle Standards) Regulations 1990, and pursuant to an authority delegated to me by the Director of Land Transport Safety, I, John Andrew Justice, Principal Engineer Vehicle Policy, hereby exempt motor vehicles operated by Motor Safe (NZ) Limited for the purpose of conducting audits of in-service inspection certifiers from the requirements listed in Schedule 1, subject to the conditions specified in Schedule 2.

Exempted requirements

(i) Traffic Regulations 1976: Regulation 58 (2) (e), 59 (3) (b), 62 (1), 78A (c), 78C (a) and 81;

(ii) Transport (Vehicle Standards) Regulations 1990: Regulation 22 (1), 29 (1) (a) and 29 (4).
