Land Acquired for Development of Public Amenity in Ashburton District
Pursuant to sections 50 and 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Grant Kasper Webley, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in the Schedule to this notice is acquired for development of public amenity and vested in Ashburton District Council on the date of publication of this notice in the New Zealand Gazette, subject to the reservation in favour of the Crown for railway purposes of the easement set out in the Second Schedule.

The formation, maintenance and repair of the right of way shall be at the sole cost of the registered proprietor of the dominant land.

Pursuant to section 236 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares the land described in the Schedule to be subject to the following restriction:
The land shall be kept clear of all vegetation above 0.5 metres and no structure of any type higher than 0.5 metres above ground level shall be erected on the land.
