Maritime Transport Act 1994

Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997.

And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime Safety by an Instrument of Delegation dated 26 March 1997.

And whereas, pursuant to section 443 of the Maritime Transport Act 1994, the Director of Maritime Safety did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to me by an Instrument of Delegation dated 26 March 1997.

Therefore I, John Norman Keith Mansell, Divisional Manager, Maritime Operations, hereby make the following declaration:

Declaration

The Order in Council under section 12 of the Submarine Cables and Pipelines Protection Act 1996, entitled the Submarine Cables and Pipelines Protection Order 1992, shall not apply in respect of the following ship:

L’Astrolabe

and workboats, zodiacs and small craft associated with that ship whilst working in the protected areas designated “Area 2–Hauraki Gulf” and “Area 5–Muriwai Beach” for the purpose of the pre-lay grapnel run for the installation of the Southern Cross Cable Network, for the period from 15 June to 3 July 1999 or for such period as is required to complete the work.

This notice comes into effect on and from the 11th day of June 1999.

and workboats, zodiacs and small craft associated with that ship whilst working in the protected areas designated “Area 2–Hauraki Gulf” and “Area 5–Muriwai Beach” for the purpose of the cable laying operation for the installation of the Southern Cross Cable Network, for the period from 23 July 1999 to 13 August 1999 or for such period as is required to complete the work.

This notice comes into effect on and from the 11th day of June 1999.

Conservation

Conservation Act 1987

Declaring Land to be Held for Conservation Purposes

Pursuant to section 7 (1A) of the Conservation Act 1987, and to a delegation from the Minister of Conservation, the Conservator of the Wellington Conservancy of the Department of Conservation, declares that the land described in the Schedule hereto is held for conservation purposes, and it shall thereafter be so held.

Wellington Land District—Wellington City

20.2519 hectares, more or less, being part Otari A2 and A3 and part Lots VI, VII and VIII, Kaiwharawhara District, situated in Block VI, Port Nicholson Survey District, subject to grants of right of way contained in B. 248427.2 and B. 526735.1. All Gazette notice B. 197554.1 (Proc 699868).
