Notice of Indemnity

Notice of indemnity given pursuant to section 59 (1) of the Public Finance Act 1989.

Pursuant to section 59 (2) of the Public Finance Act 1989, the Minister of Finance makes the following statement:

In relation to the split of the Electricity Corporation of New Zealand (ECNZ), I, the Honourable Simon William English, Minister of Finance, gave the following guarantees, executed 1 April 1999, pursuant to section 59 (1) of the Public Finance Act 1989:

a guarantees of ECNZ’s debt obligations in favour of:

i the Trustee and bondholders under ECNZ’s Domestic Bond Programme;

ii the noteholders under ECNZ’s Medium Term Note Programme; and

iii the counterparties to ECNZ’s swap agreements and the creditors under ECNZ’s Norwegian export finance arrangement with A/S Eksportfinans.

b a guarantee of ECNZ’s hedge contract obligations in favour of the counterparties to ECNZ’s hedge contracts.

In relation to the split of the ECNZ, I, the Honourable Simon William English, Minister of Finance, gave an indemnity, executed 22 December 1998, pursuant to section 59 (1) of the Public Finance Act 1989. The indemnity:

a provided ECNZ with a legal mechanism to obtain sufficient funding from the Crown to meet various liabilities or obligations should they arise as a result of the split; and

b indemnified ECNZ against any liability, which might arise under its debt and swap arrangements as a result of ECNZ entering into the Agreements for Sale and Purchase on 22 December 1998.

Fisheries Act 1996

The Fisheries (Cardinalfish Commercial Catch Limit) Notice 1999 (No. F120)

Pursuant to section 11 (4) (a) of the Fisheries Act 1996, the Minister for Food, Fibre, Biosecurity and Border Control hereby makes the following notice:

Notice

1. Title and commencement—

(a) This notice may be cited as the Fisheries (Cardinalfish Commercial Catch Limit) Notice 1999.

(b) This notice shall come into effect on the day after its notification in the New Zealand Gazette.

2. Interpretation—In this notice:

(a) CDL is defined as cardinalfish with the species name Epigonus telescopus.

(b) Area 1 means all that area defined as Fishery Management Area 1—Auckland (East) in Part 1 of the First Schedule of the Fisheries Act 1996;

(c) Area 9 means all that area defined as Fishery Management Area 9—Auckland (West) in Part 1 of the First Schedule of the Fisheries Act 1996;

3. Commercial catch limit—As from the date this notice comes into effect, the following commercial catch limits for CDL apply until 30 September 1999:

Wine Makers Levy Act 1976

Special Levy Prescribed Under the Wine Makers Levy Act 1976 (Notice No. 1124)

Pursuant to section 11 (1) of the Wine Makers Levy Act 1976, and in addition to the rate of levy prescribed by notice No. 1113 that appeared in the New Zealand Gazette on 4 February 1999, I hereby prescribe a special levy at the rate of two and one half cents (50.025) per hectolitre or part thereof on wine sales for the year ending 30 June 1998, payable by wine makers, for such purposes and on such terms as have been recommended to me by the Wine Institute of New Zealand Incorporated.
