Fisheries

Fisheries (South Island Customary Fishing) Regulations 1998

Fisheries (South Island Customary Fishing) Notice (No. 12) 1999 (No. F118)

Pursuant to regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1998, the Associate Minister for Food, Fibre, Biosecurity and Border Control hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice 1999.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) The term “customary food gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1998;

(b) Any reference to “Tangata Tiaki/Kaitiaki” means the person or persons appointed under regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1998 as Tangata Tiaki/Kaitiaki for the general customary food gathering area/rohe moana described in clause 3, and confirmed in clause 4 of this notice;

  1. Nomination of Tangata Tiaki/Kaitiaki—Te Runanga o Otakou, being the tangata whenua holding manawhenua manamoana over the area from Heywood Point to the Koau Branch of the Clutha River, extending seaward to the limit of the South Island fisheries waters as defined under regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1998, being the 200 mile limit, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996, have made the following Tangata Tiaki/Kaitiaki nominations for managing customary food gathering within this area:

(a) Tatane Alex Tarewai Wesley, Raewyn Ann Harris, Murray Robert Lindsay, William Boyd Russell, Terence Leonard Broad and Matenga Teone Taiaroa as Tangata Tiaki/Kaitiaki for the area/rohe moana from Heywood Point to Blackhead, extending seaward to the 200 mile limit, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;

(b) Paul Mataurangi Ropata and William Robert Loper as Tangata Tiaki/Kaitiaki for the area/rohe moana from Blackhead to Kuri Bush, extending seaward to the 200 mile limit, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;

(c) Edward Martin Palmer, Kiri Ann Fraser and Graeme Murray Fraser as Tangata Tiaki/Kaitiaki for the area/rohe moana from Kuri Bush to the Tokomairiro River mouth, extending seaward to the 200 mile limit, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996;

(d) Anthony Green as Tangata Tiaki/Kaitiaki for the area/rohe moana from the Tokomairiro River mouth to the Koau Branch of the Clutha, extending seaward to the 200 mile limit, and inland to boundaries defined for Te Runanga o Otakou under Te Runanga o Ngai Tahu Act 1996.

  1. Appointment of Tangata Tiaki/Kaitiaki—The Associate Minister for Food, Fibre, Biosecurity and Border Control hereby confirms the appointment of Tatane Alex Tarewai Wesley, Raewyn Ann Harris, Murray Robert Lindsay, William Boyd Russell, Terence Leonard Broad, Matenga Teone Taiaroa, Paul Mataurangi Ropata, William Robert Loper, Edward Martin Palmer, Kiri Ann Fraser, Graeme Murray Fraser and Anthony Green as Tangata Tiaki/Kaitiaki for managing customary food gathering within the particular area/rohe moana for which they were nominated in clause 3. The appointment is for a term of 5 years commencing the day this notice comes into effect.

  2. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki may authorise any individual to take fisheries resources for customary food gathering within the whole or any part of the area/rohe moana for which they are appointed.
