Electricity Industry Reform Act 1998

Notice of Exemption—Top Energy Limited

The commission, pursuant to section 81, exempts Top Energy Limited from the application of section 38 (1) (c) and section 39 of the Electricity Industry Reform Act 1998.

The exemption is subject to the following terms and conditions:

(a) Definition:

1 ‘Mirror Trust Establishment Day’ means the 90th calendar day after the day of release of the commission’s decision on Part A of Top Energy Limited’s exemption application.

2 ‘Mirror Trust Option’ has the same meaning as sections 37 to 41 of the Electricity Industry Reform Act, save for the substitution of the Mirror Trust Establishment Day for any reference in those sections to 1 April 1999; and

(b) That Top Energy Limited may, at its discretion, implement the Mirror Trust Option by the Mirror Trust Establishment Day.

(c) That Top Energy Limited shall not implement the Mirror Trust Option after the Mirror Trust Establishment Day.

(d) That Top Energy Limited shall comply with section 39 of the Electricity Industry Reform Act, as if it had not been exempted from that section and as if the Mirror Trust Establishment Day was substituted for any reference in that section to 1 April 1999.

(e) That Top Energy Limited shall be in full compliance with section 17 of the Electricity Industry Reform Act, from the Mirror Trust Establishment Day.

The commission may vary or revoke this exemption at any time in accordance with section 81 (5) of the Electricity Industry Reform Act.

The exemption takes effect from the date of publication of this notice in the New Zealand Gazette.

Notice of Exemption—Auckland International Airport Limited

The commission, pursuant to section 81, exempts Auckland International Airport Limited from the application of section 17 of the Electricity Industry Reform Act 1998, in relation to a prohibited cross-involvement in an electricity lines business and an electricity supply business, being the electricity distribution network at Auckland International Airport and the supply of electricity to consumers connected to that network.

The exemption is subject to the following terms and conditions:

(a) The exemption applies until 5.00 p.m. on 12 May 1999 after which time it expires.

(b) That Auckland International Airport Limited advises the commission of the name of the purchaser and the date of settlement of any sale and purchase agreement it negotiates with a purchaser of its electricity supply business immediately on entering such an agreement.

(c) That Auckland International Airport Limited shall be in full compliance with section 17 of the Electricity Industry Reform Act.

The commission may vary or revoke this exemption at any time in accordance with section 81 (5) of the Electricity Industry Reform Act.

The exemption takes effect from the date of publication of this notice in the New Zealand Gazette.

Land Transport Safety Authority

Heavy Motor Vehicle Regulations 1974

Introduction of Code of Practice for the Attachment of Logging Bolsters to Trucks and Trailers Used in the Transport of Logs

Pursuant to regulation 16A (1) (f) of the Heavy Motor Vehicle Regulations 1974, and pursuant to powers sub-delegated to me by the Director of Land Transport Safety, I, Peter Waring, Senior Engineer, hereby determine that the Code of Practice specified in Schedule 1, and published as a standard in the New Zealand Gazette on 14 January 1999, will take effect on the dates specified in Schedule 2.

Schedule 1

Bolster Attachment Code (issue 27 November 1998) issued on behalf of the Log Transport Safety Committee.

Schedule 2

New Vehicles

New vehicles first registered after 1 June 1999, fitted with logging bolsters must be equipped with bolster mounts certified in compliance with the code by persons approved by the Director of Land Transport Safety whose approval is supported by the recommendation of the Log Transport Safety Committee, and have their certificates of loading endorsed accordingly.

Existing Vehicles

Existing vehicles must be equipped with bolster mounts in compliance with the code before their first certificate of fitness immediately following 1 October 2000, and have their certificates of loading endorsed accordingly. The mounts are to be certified by persons approved by the Director of Land Transport Safety whose approval is supported by the recommendation of the Log Transport Safety Committee.

Notification of Ordinary Rules

Pursuant to section 161 (3) of the Land Transport Act 1998, notification is hereby given of the making of the following Land Transport Rules, which come into force on 3 May 1999:

  • Land Transport Rule: Dangerous Goods 1999
  • Land Transport (Driver Licensing) Rule 1999

These ordinary rules are available for inspection free of charge at the head office of the Land Transport Safety Authority of New Zealand, 7-27 Waterloo Quay, Wellington, and for purchase in April 1999 from...
