- The Treasurer and the Minister for Food, Fibre, Biosecurity and Border Control (the Ministers) delegate to the commission and its staff, in relation to Part III of the regulations:
(a) their powers to determine applications which do not involve “sensitive” land as described in the First Schedule to the Act and regulations under the headings of Islands, and Foreshore, lakes and reserves and Land over 0.4 hectares on certain islands;
(b) notwithstanding (a) above, their powers to determine land applications:
(i) which do not involve a freehold estate or other estate or interest in land equivalent to a freehold estate; or
(ii) which are part of a purchasing programme previously approved by the Ministers under the Overseas Investment Regulations 1985 and 1995 or the Land Settlement Promotion and Land Acquisition Act 1952, where each acquisition is consistent with any conditions established for the programme; or
(iii) involving land that is “sensitive” solely because it includes or adjoins a marginal strip that extends along and abuts any river or any stream.
- The Ministers also delegate to the commission and its staff the following related matters:
(a) their powers under regulation 12 to specify information and particulars to be supplied by applicants;
(b) their powers under regulation 14 in respect of applications:
(i) which have been delegated in terms of paragraphs 4 and 5 above; or
(ii) which have been initially considered by the Ministers and that require an administrative amendment.
(c) their powers under regulation 16 in respect of applications that have been delegated in terms of paragraphs 4 and 5 above.
(d) their powers under regulation 16 in respect of adding entities to or deleting entities from the Schedules to the Overseas Investment Exemption Notice 1995;
(e) their powers under regulation 17 in respect of any matter delegated;
(f) their powers under section 15 of the Act in respect of applications that have been delegated; and
(g) in each case where a power has been delegated, the power of delegation under section 16 of the Act.
Criteria
- In considering any applications under delegation the commission and its staff must take into account the matters provided for under section 14A of the Act.
Revocation of Existing Delegation
- The existing delegation conferred on the commission and its staff on 21 December 1995 is hereby revoked as from the date of this letter.

Conservation
Conservation Act 1987
Declaring the Disposition of Land to be Exempt From Section 24 of the Conservation Act 1987
Pursuant to section 24B (4) (b) of the Conservation Act 1987, the Minister of Conservation, hereby declares that section 24 of the Conservation Act 1987, which deals with the reservation of marginal strips, shall not apply to the disposition of the land in the Schedule hereto.
The land is part of a sea wall that protects the New Plymouth Power Station, an area that is required in connection with electricity works.

Taranaki Land District—New Plymouth District
4580 square metres, more or less, being the land shown as “A” and “B” on S.O. Plan 14647.

Declaring Land to be Held for Conservation Purposes, Together With a Declaration That the Areas Become Reserves and Vesting of the Reserves in The Queenstown Lakes District Council
Pursuant to section 7 (1A) of the Conservation Act 1987, and to a delegation from the Minister of Conservation, the Conservator, Otago Conservancy Department of Conservation, hereby declares that the land described in the Schedule hereto is held for conservation purposes and pursuant to section 8 (1A) of the Act, the Conservator further declares that the conservation areas shall hereafter be set apart as reserves, subject to the Reserves Act 1977, and classified for the purposes specified at the end of the respective descriptions of the said land, subject to the provisions of the latter Act.
Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Conservator vests the said reserves in The Queenstown Lakes Council in trust for those purposes.

1138 square metres, more or less, being Section 24, Block VII, Town of Frankton. No certificate of title (local purpose, beautification).
207 square metres, more or less, being Section 26, Block I.
