Public Works Act 1981

Amending a Notice Realigning State Highway No. 25, Kuaotunu Hill — Thames-Coromandel District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, hereby amends the notice dated 11 January 1999, realigning a road, published in the New Zealand Gazette of 21 January 1999, No. 4 at page 132, by:

(a) Deleting clause (b) in the head recital and substituting it with the following clause:

"(b) Pursuant to sections 117 (3) and 120 (3), declares the stopped road in the Second Schedule to this notice to be amalgamated with the land in certificate of title No. 38C/750, subject to section 8 of the Coal Mines Amendment Act 1950, sections 10 and 11 of the Crown Minerals Act 1991, Part IVA of the Conservation Act 1987, exploration permit B. 406958 and mortgage B. 413314."

(b) Deleting the Second Schedule and substituting it with the following:

Second Schedule

Stopped Road to be Amalgamated

Road Realignment in the District of Grey

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to this notice to be road and vested in The Grey District Council.

(b) Pursuant to sections 116 (1), 117 and 120 (3), declares the portions of road described in the Second Schedule to this notice to be stopped and amalgamated with the land in the certificate of title No. 5B/710, subject to section 8 of the Mining Act 1971 and section 5 of the Coal Mines Act 1979 and memorandum of mortgage 091751.5.
