The Registrar proposes to act under section 328 (1) (c) of the Companies Act 1993, on the grounds that at the time the companies were removed from the Register, the companies were in receivership, or liquidation or both.

Any person who objects to the restoration of any of these companies to the Register must deliver a notice of that objection in writing to the District Registrar at Auckland within 20 working days from the date of this notice.

Any person who objects to the restoration of any of these companies to the Register must deliver notice of that objection in writing to the District Registrar at Hamilton within 20 working days from the date of this notice.

Advertisement of Application for Order

Under Section 174 of the Companies Act 1993

Take notice that on the 22nd day of December 1998, an application for an order under section 174 of the Companies Act 1993, in respect of Perry CM Limited was filed in the High Court at New Plymouth.

The orders sought are:

(a) An order requiring Perry CM Limited, or Construction Mechanics Limited, or Maxwell John Gray to acquire the shares of Isofoam Proprietary Limited;

(b) An order requiring Maxwell John Gray and/or Construction Mechanics Limited to pay compensation to Isofoam Proprietary Limited; and

(c) such other orders as the Court deems just.

The application is to be heard before the High Court at New Plymouth on the 3rd day of March 1999 at 10.00 a.m.

Any person, other than the defendant company, who wishes to appear on the hearing of the application must file an appearance not later than the second working day before that day.
