Fisheries (Kaimoana Customary Fishing) Regulations 1998

Fisheries (Kaimoana Customary Fishing) Notice (No. 1) 1999 (No. F142)

Pursuant to regulation 9 (2) of the Fisheries (Kaimoana Customary Fishing) Regulations 1998, the Manager Operational Policy, Ministry of Fisheries acting pursuant to delegated authority from the Associate Minister for Food, Fibre, Biosecurity and Border Control hereby gives the following notice.

1. Title and commencement—(1) This notice may be cited as the Fisheries (Kaimoana Customary Fishing) Notice (No. 1) 1999

(2) This notice shall come into effect the day after the date of its notification in the Gazette.

2. Interpretation—In this notice:

(a) The term “Customary food gathering” has the same meaning as defined in the Fisheries (Kaimoana Customary Fishing) Regulations 1998;

(b) Any reference to “Kaitiaki” means the person or persons appointed under regulation 9 of the Fisheries (Kaimoana Customary Fishing) Regulations 1998 as Tangata Kaitiaki/Tiaki for a general customary food gathering area/rohe moana and confirmed in clause 4 of this notice;

(c) Any reference to “area/rohe moana” means the area described by a line beginning from the middle of the Waikare River mouth (39° 11.0′ S 177° 5.2′ E), then perpendicular to the coastline out to reference point (39° 21.4′ S 177° 11.9′ E), then due south to reference point (39° 26.9′ S 177° 9.6′ E), then due west to Bluff Hill (39° 28.9′ S 177° 55.2′ E), and then generally westerly and northerly following the coastline to the point of commencement.

3. Nomination of Kaitiaki—Ngai Te Ruruku o Te Rangi (with support from the hapū of Tangoio Marae), being the tangata whenua holding manawhenua manamoana over the area/rohe moana, have nominated Rangi Spooner and Te Aranui Boyce Spooner as Kaitiaki for the area/rohe moana.

4. Appointment of Kaitiaki—The Manager Operational Policy, Ministry of Fisheries hereby confirms the appointment of Rangi Spooner and Te Aranui Boyce Spooner as Kaitiaki for managing customary food gathering for the area/rohe moana by the Associate Minister for Food, Fibre, Biosecurity and Border Control. The appointment will commence the day after this notice is published.

5. Power to authorise taking of fisheries resources for customary food gathering—The Kaitiaki may authorise any individual to take fisheries resources managed under the Fisheries Acts 1983 and 1996, other than those fisheries resources that are taken in fresh water, for customary food gathering purposes from within the whole or any part of the area/rohe moana. No customary food gathering of fisheries resources may take place in the area/rohe moana without authorisation from the Kaitiaki.

(c) Any reference to area/rohe moana means the area described by a line beginning on the coastline at Waihau Beach (38° 27.3′ S 178° 18.1′ E) south-east to the 200 Nautical Mile Limit (40° 02.5′ S 178° 50.0′ W), then generally south along the 200 Nautical Mile Limit to reference point (40° 21.5′ S 178° 57.5′ W), then north-west to Tatapouri Point (38° 38.8′ S 178° 08.8′ E) and then north-east following the coastline to the point of commencement.

3. Nomination of Kaitiaki—Ngāti Konohi, being the tangata whenua holding manawhenua manamoana over the area/rohe moana, have nominated Mr Heta Matete, Mr Tangiwai Matete and Mr Hone Taumaunu as Kaitiaki for the area/rohe moana.

4. Appointment of Kaitiaki—The Manager Operational Policy, Ministry of Fisheries hereby confirms the appointment of Mr Heta Matete, Mr Tangiwai Matete and Mr Hone Taumaunu as Kaitiaki for managing customary food gathering for the area/rohe moana by the Associate Minister for Food, Fibre, Biosecurity and Border Control. The appointment will commence the day after this notice is published.

5.
