Water Easement Acquired—Waihou Valley Scheme—Thames-Coromandel District

Pursuant to section 20 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the right to drain water easement described in the Second Schedule hereto, is hereby acquired as an easement in gross over those parts of the land described in the First Schedule as are specified in the Second Schedule, and shall vest in The Waikato Regional Council (called the grantee) on the date of publication hereof in the New Zealand Gazette. This easement may be surrendered at any time by notice in the New Zealand Gazette.

Right to Drain Water

The right to drain water over all those pieces of land described as follows:

(2) Part Section 6, Block XII, Thames Survey District; marked “C” on D.P. S. 67348.

(3) Part Lot 1, D.P. S. 15429; marked “D” on D.P. S. 67348.

Terms and Conditions of Easement

(1) The terms and conditions of the easement shall be in accordance with those set out in paragraphs 3 and 5 of the Seventh Schedule of the Land Transfer Act 1952, modified as follows:

(a) The grantee shall clean the 2 culverts and drains at least each third year with the drain being sprayed in the intervening years. If the grantee fails to do so, the owner may clean the culverts and send on the account for reasonable costs of cleaning the culverts to the grantee for payment and the grantee shall pay such account.

(b) The grantee shall replace both of either of the culverts if they or either one falls into disrepair within a week of being notified that the culverts or culvert require to be replaced. The replacement culvert will not be less than the existing diameter and width.

Land Acquired for a Limited Access Road—State Highway No. 3, Mangatea Road South, Waitomo District

Pursuant to section 20 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, has become road, limited access road, and State highway and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Pursuant to sections 116 (1), 117 and 120 (3) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Property Officer, Land Information New Zealand, Wellington, declares the road described in the Schedule to be stopped and shall be amalgamated with the land in certificate of title 42D/312, subject to mortgage B. 250062.4.
