New Zealand Dairy Board Notice to Acquire Dairy Produce Intended for Export
[Authority: Board Resolution No: 10914]
Notice of Acquisition
Resolution to Acquire Dairy Produce for Export
In terms of section 18 of the Dairy Board Act 1961 (“the Act”), the New Zealand Dairy Board (“the board”) hereby resolves, from the date of this notice until further notice, to acquire all export produce (as defined in the Act) where all milksolids (as defined in the Act) used in the production of that export produce are from milk from dairy cows milked in New Zealand.
On application under section 17 (1A) of the Act, the board may grant specific permission to any person who wishes to export dairy produce of any kind or description in accordance with section 17 (b) of the Act. No person may export dairy produce (including produce subject to this notice) from New Zealand without such permission.
Unless otherwise agreed in writing between the board and the supplier of export produce, ownership of export produce will pass to the board on the last day of the month during which advice of the product’s manufacture was entered, or deemed to be entered, into the board’s stock system. Where advice of the product’s manufacture is received by the board from a supplier after the end of a month but before the latter of the fourth calendar day or the third working day of the month, then such advice will be deemed to be entered into the board’s stock system on the last day of the previous month.
After export produce has become the property of the board, in accordance with this notice, such produce may become the property of the supplier again:
(a) on agreement between the board and the supplier prior to final grading of the product; and
(b) at the board’s option upon the board finding such export produce to be contaminated or to contain foreign matter to such an extent that it does not conform to the board’s specification prescribed in the board’s order for that produce.
The terms and conditions of acquisition set out above have been adopted by the board under the statutory powers of sections 17 and 18 of the Act.
Board Resolution 10545 and Notice No. 3781 in the Gazette of 13 June 1996, No. 61, page 1532 are hereby revoked.
Dated this 1st day of June 1998.
