Airworthiness Directive

Pursuant to section 72I (3) (a) of the Civil Aviation Act 1990, and to a delegation from the Director of Civil Aviation, I, Geoffrey Neil Connor, Safety Analyst – Continuing Airworthiness, hereby issue the following airworthiness directives in respect of aircraft or aeronautical products:

These airworthiness directives shall come into force on 30 April 1998.

Traffic Regulations 1976

Exemption From the Seat Belt Requirements of the Traffic Regulations 1976 and the Transport (Vehicle Standards) Regulations 1990

Pursuant to regulation 90 (1) of the Traffic Regulations 1976 and pursuant to regulation 36 of the Transport (Vehicle Standards) Regulations 1990, I, John Andrew Justice, Senior Engineer, hereby exempt the motor vehicles specified in Schedule 1 of this notice from the requirements specified in Schedule 2, subject to the conditions specified in Schedule 3.

The notice in the New Zealand Gazette, No. 161 of 13 November 1997, page 3784, titled “Exemption From the Seat Belt Requirements of the Traffic Regulations 1976 and the Transport (Vehicle Standards) Regulations 1990” and referred to as “au8177” is hereby revoked.

Schedule 1

Vehicle Details

Motor vehicles of Classes MA, MB and MC with sideways-facing seating positions to the rear of the driver’s seating position.

Schedule 2

Exempted requirements

Traffic Regulations 1976: Regulation 78A (c)

Transport (Vehicle Standards) Regulations 1990: Regulation 29 (1) (c)

Schedule 3

Conditions

(i) Any sideways-facing seating positions to the rear of the driver’s seating position in vehicles specified in Schedule 1 may be fitted with two-point lap seat belts as an alternative to the seat belts required by the regulations specified in Schedule 2;

(ii) Any retrofitted sideways-facing seats must be securely anchored to the vehicle by means of seat anchorages that are fit for their purpose;

(iii) Any retrofitted seat belt anchorages must comply with Specification St 31391 or, if this is not applicable, Specification St 120395;

(iv) Any seat belts fitted must comply with one or more of the appropriate standards listed in Item 18 of the Second Schedule to the Transport (Vehicle Standards) Regulations 1990;

(v) At all times, any seat belts fitted must be in sound condition and good working order in accordance with regulation 78c of the Traffic Regulations 1976; and

(vi) This exemption may be revoked at any time.

Exemption From Specified Requirements of the Traffic Regulations 1976

Pursuant to regulation 90 (1) of the Traffic Regulations 1976, I, James Lindsay Graham Bell, Vehicle Compliance Officer, hereby exempt the motor vehicle specified in Schedule 1 of this notice from the requirements of the Traffic Regulations 1976 listed in Schedule 2, subject to the conditions specified in Schedule 3.
