Notice of Granting of an Open Aviation Market Licence

Pursuant to section 87U (4) of the Civil Aviation Act 1990, and a delegation from the Secretary for Transport dated 28 August 1996, I give notice that, having received an application from Federal Express Corporation of Memphis, Tennessee, United States of America, I have granted that airline an open aviation market licence to carry on scheduled services and non-scheduled flights in accordance with the 18 June 1997 Air Transport Agreement Between the Government of New Zealand and the Government of the United States of America, for an indefinite term with effect from 1 May 1998.

Notice of Intention to Consider Varying a Scheduled International Air Service Licence

Pursuant to section 87 (3) of the Civil Aviation Act 1990, and a delegation from the Secretary for Transport dated 28 August 1996, I give notice that, having received an application from Air New Zealand Limited, the Minister of Transport intends to consider varying the Scheduled International Air Service Licence issued to that airline to:

(i) with respect to the United Kingdom, provide for the operation of up to 6 services per week via Los Angeles to points in the United Kingdom; and

(ii) with respect to Singapore, provide for services to be carried beyond Singapore to points in the United Kingdom.

Any person or organisation wishing to make representations relating to this proposal must forward those representations in writing to reach me at the Ministry of Transport, P.O. Box 3175, Wellington, on or before 14 May 1998.

British Settlements Act 1887

Officer of the Government of Ross Dependency Appointed

MICHAEL HARDIE BOYS, Governor-General

Background—

A. An Order in Council dated 30 July 1923* (“the order”) made under the British Settlements Act 1887 (U.K.) appoints the Governor-General of New Zealand to be the Governor of the Ross Dependency (“the Governor”) and vests in the Governor certain powers:

B. The order empowers the Governor to make rules and regulations for the peace, order, and good government of the Dependency:

C. Regulations made by the Governor on 14 November 1923† provide that all persons appointed by the Governor may be empowered to do such things as may be necessary or desirable to ensure that the laws in force in the Dependency are duly observed and complied with in every respect, and to do all things necessary or expedient for the peace, order, and good government of the Dependency, and to safeguard and preserve Her Majesty’s rights and sovereignty over and in respect of the Dependency:

D. It is now expedient that Stephen Mark Franklin be appointed to be an officer of the Government of the Dependency at Scott Base during the period beginning with this appointment and ending with the close of 16 October 1998:

I confer on Stephen Mark Franklin, while he holds office as an officer of the Government of the Dependency, all the powers exercisable in New Zealand by a Justice of the Peace, and also the powers exercisable in New Zealand by a Coroner:

Stephen Mark Franklin is to exercise his functions at such places within the Dependency as may be directed by an officer of the Government of the Dependency who has the general executive and administrative authority in preserving Her Majesty’s rights and sovereignty and the laws in force in the Dependency.

As witness the hand of His Excellency the Governor-General as the Governor of the Ross Dependency, this 6th day of April 1998.
