(c) "Home cordless" means any radio apparatus designed to provide a wireless extension to a telephone or terminal or data terminal which is connected to a network, but does not include a wireless PABX.

(d) "Wireless PABX" means any radio apparatus designed to provide a wireless extension to PABX equipment.

(e) "PABX" and "Network" have the meaning given to those terms by section 2 of the Telecommunications Act 1987.

  1. General licence—A licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is hereby granted for the installation, operation, and use by persons in New Zealand of radio apparatus known as the Personal Handy Phone System (PHS) intended for radiocommunications within New Zealand.

  2. Terms, conditions and restrictions—(1) The range of frequencies available for use under this licence are 1895 MHz to 1920 MHz.

(2) This licence applies only to radio apparatus that complies with the Association of Radio Industries and Businesses (ARIB) Standard, Version 2, RCR STD-28 and subsequent amendments and in respect of which a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993.

(3) Installation, operation, and use of wireless PABX apparatus, wireless local loop systems and home cordless apparatus is permitted.

(4) Installation, operation, and use of a public service is not permitted.

(5) Installation, operation, and use of radio apparatus under the licence is not permitted within the geographical areas described in the Schedule.

(6) Frequency use is on a shared basis and the Secretary does not accept any liability under any circumstances for any loss or damage of any kind occasioned by the unavailability of frequencies or interference to reception.

(7) Power output is limited to 160 mW Pk equivalent isotopically radiated power.

  1. Period of validity of licence—This licence shall expire on 31 January 1999.

Schedule
Installation, operation and use not permitted—(a) Radio apparatus under this licence must not be installed, operated, or used within the minimum distance, in kilometres, of a path between the transmitter location and associated receiver location specified in Table 1.

(b) The transmitter location and receiver location in Table 1 are to be read in conjunction with the associated grid reference taken from the Infomap 260 series of maps published by Land Information New Zealand.

Explanatory Note
This note is not part of the notice, but is intended to indicate its general effect.

This notice prescribes that, pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, a general licence is granted in respect of the installation, operation, and use of radio apparatus on frequencies specified in this notice. The licence only applies to radio apparatus which complies with technical specification ARIB Standard, Version 2, RCR STD-28 and subsequent amendments and in respect of which a declaration of conformity has been submitted to the Secretary under regulation 43 of the Radiocommunications (Radio) Regulations 1993. This notice comes into effect on 1 March 1998.

Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993 ("the regulations"), and acting under delegated authority from the Secretary of Commerce, I hereby give the following notice:

  1. Short title and commencement—(1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for Digital Enhanced Cordless Telecommunications) Notice 1998.

(2) This notice shall come into force on 1 March 1998.

  1. Interpretation—For the purposes of this notice:

(a) "Wireless local loop" means a telecommunications system which provides wireless access to a network for a number of handsets or terminals or data terminals, typically to serve a residential area, but does not include a system which allows for the automatic switching of handsets or terminals or data terminals between telecommunications systems.

(b) "Public service" means a system which enables a subscriber to use a handset or terminal or data terminal to access a network and to transmit or receive telephone calls in public places where base stations have been installed and includes a system which allows for the automatic switching of handsets or terminals or data terminals between telecommunications systems.

(c) "Home cordless" means any radio apparatus designed to provide a wireless extension to a telephone or terminal or data terminal which is connected to a network, but does not include a wireless PABX.

(d) "Wireless PABX" means any radio apparatus designed to provide a wireless extension to PABX equipment.

(e) "PABX" and "Network" have the meaning given to those terms by section 2 of the Telecommunications Act 1987.
