Maritime Transport Act 1994

Declaration Under the Submarine Cables and Pipelines Protection Act 1996

Whereas, pursuant to section 441 of the Maritime Transport Act 1994, the Minister of Transport did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Maritime Safety Authority by an Instrument of Delegation dated 19 March 1997.

And whereas, pursuant to section 442 of the Maritime Transport Act 1994, the Maritime Safety Authority did delegate those powers under section 12 (6) of the Submarine Cables and Pipelines Protection Act 1996 to the Director of Maritime Safety by an Instrument of Delegation dated 26 March 1997.

Therefore I, Russell Paul Kilvington, Director of Maritime Safety, hereby make the following declaration:

Declaration

The Order in Council under section 12 of the Submarine Cables and Pipelines Protection Act 1996, entitled the Submarine Cables and Pipelines Protection Order 1992, shall not apply in respect of the following ship:

Mahi

and small barge associated with that ship whilst working in the protected area designated “Area 2-Hauraki Gulf” for the purpose of carrying out temporary repairs to a severed sea-earth submarine cable under the control of Telecom New Zealand Limited, for the period required to complete the repairs.

This notice comes into effect on and from Monday, the 21st day of December 1998.

Transit New Zealand Act 1989

Revoking Section of State Highway — Declaring New Section of State Highway — State Highway No. 1 : Tamahere Deviation

Pursuant to section 60 of the Transit New Zealand Act 1989, the Transit New Zealand Authority gives notice that the section of State Highway No. 1 described in the First Schedule hereto, is revoked and the section of State highway described in the Second Schedule hereto, is declared to be State Highway No. 1 within the meaning and for the purpose of the Transit New Zealand Act 1989.

First Schedule

That section of State Highway No. 1 at Tamahere, commencing at its junction with Bollard Road (Route Position 468/2.58) proceeding in a south-easterly direction to its junction with Pickering Road (Route Position 467/7.24); a distance of 3.74 kilometres.

Second Schedule

That section of road at Tamahere, known as the Tamahere Deviation from its intersection with Bollard Road (Route Position 468/2.58) proceeding in a south-easterly direction to its junction with Pickering Road (Route Position 468/6.12); a distance of 3.54 kilometres.
