The Ernest Marsden Trust

Notice of Application for Approval of a Scheme

Pursuant to Part III of the Charitable Trusts Act 1957

The public trustee, as trustee of the will of Ernest Marsden, late of Lowry Bay in New Zealand, retired civil servant, deceased, has filed in the Registry of the High Court at Wellington a scheme to vary the terms of The Ernest Marsden Trust.

Under the will trusts the trust fund is to be applied by the Royal Society of New Zealand or failing acceptance by Victoria University of Wellington in and towards promoting research into natural radioactivity and fallout, particularly in relation to human health in New Zealand.

Neither the society nor the university have accepted those trusts and under the scheme the public trustee shall pay the trust fund to Victoria University of Wellington for one or more research scholarships in any area of experimental physics having the potential to benefit the health and well being of New Zealanders.

Copies of the scheme and the report of the Attorney-General thereon may be inspected, free of charge, at the office of the Registrar of the High Court at Wellington or at the office of the public trustee, corner of Margaret and Dudley Streets, Lower Hutt.

The application has been set down for hearing in the High Court at Wellington on the 1st day of February 1999 at 10.00 a.m.

Any person desiring to oppose the scheme is required to give notice of intention to do so to the Registrar of the High Court at Wellington and to the public trustee at Lower Hutt and the Attorney-General, not less that 7 clear days before the above-mentioned date.
