Easement in Gross Acquired for Right of Way, Porirua District

Pursuant to section 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, pursuant to an agreement being entered into, the following easement in gross is acquired for right of way, over the land described in the Schedule to this notice and is vested in the Crown on the date of publication of this notice in the New Zealand Gazette. The terms of the right of way are those set out in the Seventh Schedule to the Land Transfer Act 1952 and the Ninth Schedule to the Property Law Act 1952; substituting clause 2 (c) with:

2 (c) The right to a reasonable contribution from other occupiers towards the cost of maintenance, upkeep, and repair of the driveway to an appropriate standard. However the grantor will at the grantor’s cost maintain the track on the land over which the easement is granted to at least the standard required for all weather 4-wheel drive access over the land. This obligation will cease once the motorway intended to be constructed on part of the dominant tenement has been completed.
