Order for Confiscation of Motor Vehicle

Pursuant to Section 84 of the Criminal Justice Act 1985

On the 2nd day of November 1998 at the District Court at Tauranga, Benjamin Anderson of 432 Pukehina Parade, R.D.9, Pukehina, was convicted and sentenced to 18 months imprisonment suspended for 2 years, 6 months periodic detention and disqualified from holding or obtaining a motor driver’s licence for 2 years from 2 November 1998 following his conviction on 2 November 1998, for an offence of refusing to permit specimen of blood.

And in addition to the above-mentioned penalty, Judge D. C. McKegg has ordered that a

Datsun 120Y motor vehicle, registered No. IX 4742

owned by the above-mentioned defendant, be forfeited to Her Majesty the Queen, pursuant to section 84 (4) of the Criminal Justice Act 1985.

The vehicle is to be surrendered to the Registrar, District Court, Tauranga, or a Bailiff of the District Court, Tauranga, by 4.00 p.m. on the 2nd day of November 1998.

Pursuant to Section 84 of the Criminal Justice Act 1985

On the 9th day of November 1998 at the District Court at Tauranga, Daniel Noel Harley of 38 Campbell Road, Mount Maunganui, was convicted and disqualified from holding or obtaining a motor driver’s licence for 6 months from 24 February 1999 following his conviction on 9 November 1998, for an offence of driving with excess breath alcohol.

And in addition to the above-mentioned penalty, Judge D. C. McKegg has ordered that a

owned by the above-mentioned defendant, Daniel Noel Harley be forfeited to Her Majesty the Queen, pursuant to section 84 (4) of the Criminal Justice Act 1985.

The vehicle is to be surrendered to the Registrar, District Court, Tauranga, or a Bailiff of the District Court, Tauranga, by 4.00 p.m. on the 9th day of November 1998.
