Road Realignment—Mikimiki Road, Masterton District

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand,

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to this notice to be road and vested in The Masterton District Council, on the date of publication hereof in the New Zealand Gazette.

(b) Pursuant to section 116 (1), 117 (3) and 120 (3), declares

(i) the area of road firstly described in the Second Schedule to this notice to be stopped and amalgamated with the land in certificate of title No. 33/254, and

(ii) the area of road secondly described in the Second Schedule to this notice to be stopped and amalgamated with the land in certificate of title No. 44A/849, subject to mortgage B. 433864.5.

Land Acquired for Soil Conservation and River Control Purposes in Hawke’s Bay District—Part Ngatarawa 2E2Z1

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, declares that, pursuant to an agreement to that effect having been entered into, the land described in that Schedule to this notice is hereby acquired for soil conservation and river control purposes and is vested in The Hawke’s Bay Regional Council on the date of publication of this notice in the New Zealand Gazette.

Land Acquired for Waterworks in Masterton District—Upper Plain Road

Pursuant to sections 17 and 20 of the Public Works Act 1981, and by a delegation from the Minister of Lands, Ronald Alistair Jolly, Land Information New Zealand, hereby declares the land in the First Schedule to this notice, and the riparian rights (ad medium filum aquae) of the adjoining owner of the land described in the Second Schedule, to be taken, an agreement to that effect having been entered into for

(a) Waterworks for the purposes of water supply and vested in The Masterton District Council from the date of publications of this notice in the New Zealand Gazette, and together with;

(b) An easement in gross to convey water as defined in the Seventh Schedule of the Land Transfer Act 1952 over areas K, A, and B described in the Third Schedule, and

(c) An easement in gross of right of way, as defined in the Seventh Schedule of the Land Transfer Act 1952 over areas K, A, and B described in the Third Schedule, subject to and together with the rights implied by vehicular access by the Ninth Schedule of the Property Law Act 1952.

(d) An easement in gross of right of way, as defined in the Seventh Schedule of the Land Transfer Act 1952 subject to and together with the rights implied by vehicular access by the Ninth Schedule of the Property Law Act 1952 over area C described in the Fourth Schedule.
