Order for Confiscation of Motor Vehicle

Pursuant to Section 84 of the Criminal Justice Act 1985

On the 8th day of September 1998 at the District Court at Hamilton, John Oswald Bishop of Tahuna Road, R.D. 3, Morrinsville, was convicted and sentenced to a fine of $100 and Court costs of $130 and disqualified from holding or obtaining a motor driver’s licence for 6 months from the 8th day of March 1999, following his conviction on the 8th day of September 1998 for an offence of driving while disqualified and in addition to the above-mentioned penalty, Judge M. L. S. F. Burnett, has ordered that a 1996 Holden Commodore motor vehicle, registration No. TX 7507

owned by the above-mentioned defendant, John Oswald Bishop be forfeited to Her Majesty the Queen, pursuant to section 84 (4) of the Criminal Justice Act 1985.

The vehicle is to be surrendered to the Registrar, District Court, Hamilton, or a Bailiff of the District Court, on the 8th day of September 1998, or as soon thereafter as practicable.

Education Act 1989

Merger of Orawia School and Clifden School

Pursuant to section 156a (1) of the Education Act 1989, I hereby declare that Orawia School (3994) and Clifden School (3938), will merge on the 27th day of January 1999, and become a contributing primary school.

Clifden School will be the continuing school.

Dissolution of a Board of Trustees

Pursuant to section 107 (1) of the Education Act 1989, I am satisfied that the Board of Trustees of Awarua School (1005) should not continue in existence by reason of mismanagement, disharmony and lack of action. I hereby dissolve the Awarua School Board of Trustees to take effect from the day after the date of this publication and direct the Secretary for Education to appoint a commissioner to act in its place.

Fisheries Act 1983

Fisheries (South Island Customary Fishing) Notice (No. 2) 1998 (No. F98)

Pursuant to regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1998, the Minister for Food, Fibre, Biosecurity and Border Control hereby gives the following notice.

Notice

  1. Title and commencement—(1) This notice may be cited as the Fisheries (South Island Customary Fishing) Notice 1998.

(2) This notice shall come into effect the day after the date of its notification in the New Zealand Gazette.

  1. Interpretation—In this notice:

(a) The term “Customary food gathering” has the same meaning as defined in the Fisheries (South Island Customary Fishing) Regulations 1998.

(b) Any reference to “Tangata Tiaki/Kaitiaki” means the person or persons appointed under regulation 9 of the Fisheries (South Island Customary Fishing) Regulations 1998 as Tangata Tiaki/Kaitiaki for a general customary food gathering area/rohe moana and confirmed in clause 4 of this notice.

(c) Any reference to area/rohe moana means the area between the Pareora River and Whakatu, just north of the Hakateramea/Ashburton River, from Te Tiriti o Te Moana to Te Moana Nui a Kiwa, extending seaward to the limit of the South Island fisheries waters as defined under regulation 2 of the Fisheries (South Island Customary Fishing) Regulations 1998; and inland to the boundaries defined for Te Runanga o Arowhenua in the First Schedule of Te Runanga o Ngai Tahu Act 1996.

  1. Nomination of Tangata Tiaki/Kaitiaki—Te Runanga o Arowhenua Trust, being the tangata whenua holding manawhenua manamoana over the area/rohe moana have nominated Teao Hurae Waaka, Freda Daphne Browne, Elizabeth A. Stevenson, Yvonne Enoka, Rosina Hix, John P. Brooking and Ernest Arved Heta Johnston as Tangata Tiaki/Kaitiaki for the area/rohe moana.

  2. Appointment of Tangata Tiaki/Kaitiaki—The Minister for Food, Fibre, Biosecurity and Border Control hereby confirms the appointment of Teao Hurae Waaka, Freda Daphne Browne, Elizabeth A. Stevenson, Yvonne Enoka, Rosina Hix, John P. Brooking and Ernest Arved Heta Johnston as Tangata Tiaki/Kaitiaki for managing customary food gathering in the area/rohe moana. The appointment is for a term of 5 years commencing the day this notice comes into effect.

  3. Power to authorise taking of fisheries resources for customary food gathering—The Tangata Tiaki/Kaitiaki
