Notice of Decision of the Disciplinary Tribunal of the Institute of Chartered Accountants of New Zealand
At a hearing held on 26 June 1997, the Disciplinary Tribunal of the Institute of Chartered Accountants of New Zealand heard 1 charge against Jeffrey Thomas Chapman, formerly of Wellington, now Auckland.
Jeffrey Thomas Chapman did not appear before the disciplinary tribunal and pleaded not guilty to 1 part of the charge. After hearing submissions on behalf of the professional conduct committee, the disciplinary tribunal found the member:
A. Guilty of an offence punishable by imprisonment and conviction which reflected on his fitness to practice accountancy and tended to bring the profession into disrepute. Acting under rule 21.31 of the rules of the Institute of Chartered Accountants of New Zealand the disciplinary tribunal ordered that Jeffrey Thomas Chapman be removed from the Register of Members of the institute and imposed a monetary penalty of $4,000.
Jeffrey Thomas Chapman was also ordered to pay to the institute the sum of $4,723 in respect of the costs and expenses relating to the inquiry by the disciplinary tribunal and of the investigation by the professional conduct committee.
An appeal against the penalty imposed and the costs awarded by the disciplinary tribunal was heard by the appeals council of the institute at a meeting on 11 August 1998.
The appeals council considered both written and oral submissions made by the member and on behalf of the professional conduct committee. The appeals council concluded the discretion available to the disciplinary tribunal had been appropriately exercised, and confirmed the monetary penalty and award of costs. The appeals council reserved its decision on costs, pending submissions from the appellant and counsel for the professional conduct committee.
The appeals council confirmed that the decision be published in the Chartered Accountants Journal of New Zealand, the New Zealand Gazette and for distribution through the New Zealand Press Association, with mention of the member’s name and locality.
