Notice of Product Ruling

  1. This is a notice of a product ruling made under section 91F of the Tax Administration Act 1994.

  2. Product ruling No. 97/68 is issued on 13 August 1997. It relates to withdrawals from a superannuation fund, and the application of sections HH 3 (5), JB 3 (1), and definitions within section OB 1 of the Income Tax Act 1994. It will appear in Inland Revenue’s Tax Information Bulletin, Vol. 9, No. 9 of September 1997.

  3. A copy of the ruling may be obtained by writing to the Assistant General Manager (Adjudication & Rulings), National Office, Inland Revenue, P.O. Box 2198, Wellington.

Gaming and Lotteries Act 1977

Permission to Conduct Within New Zealand a Lottery Promoted Outside New Zealand

Pursuant to section 69 of the Gaming and Lotteries Act 1977, I, Jack Elder, Minister of Internal Affairs, hereby permit Ryobi Australia Pty Limited, to conduct within New Zealand, subject to the conditions specified in the Schedule to this notice, a lottery promoted outside New Zealand as a sales promotion scheme, to promote the sale of Ryobi power tools in K-Mart stores.

Schedule

Conditions

The permission given by this notice is subject to the following conditions, namely:

(1) Ryobi Australia Pty Limited, shall not conduct the sales promotion scheme in New Zealand after 22 September 1997;

(2) The results of the sales promotion scheme shall be published in the Sunday Star Times on 5 October 1997; winners will be notified by certified mail;

(3) New Zealand winners shall not be subject to any extra cost when they claim their prizes;

(4) The chance of a New Zealand participant winning a prize shall be equal to that of an overseas participant.

Pursuant to section 69 of the Gaming and Lotteries Act 1977, I, Jack Elder, Minister of Internal Affairs, hereby permit Barter Card Limited, to conduct within New Zealand, subject to the conditions specified in the Schedule to this notice, a lottery promoted outside New Zealand as a sales promotion scheme, to promote the use of the Barter Card trading system.

Conditions

The permission given by this notice is subject to the following conditions, namely:

(1) Barter Card Limited, shall not conduct the sales promotion scheme in New Zealand after 30 October 1997;

(2) The results of the sales promotion scheme shall be published in The Barter Bulletin on 2 December 1997; winners will be notified by certified mail;

(3) New Zealand winners shall not be subject to any extra cost when they claim their prizes;

(4) The chance of a New Zealand participant winning a prize shall be equal to that of an overseas participant.

Civil Aviation Act 1990

Designation of International Air Routes as Non-Smoking

Pursuant to section 96A (2) (a) of the Civil Aviation Act 1990, I, Jennifer Mary Shipley, designate, without exception, all international air routes and parts of international air routes operated by New Zealand international airlines as non-smoking routes.

I hereby revoke the previous notice in the New Zealand Gazette of 12 December 1996.

This notice shall take effect from 1 November 1997.

Notice of Intent to Consider Varying a Scheduled International Air Service Licence

Pursuant to section 87 (3) of the Civil Aviation Act 1990, I give notice that, having received an application from Air New Zealand Limited, the Minister of Transport intends to consider varying the international air service licence held by that airline to provide for:

(i) in respect of Singapore, the operation of services via Australia;
