Notice of Functions That the Transitional Health Authority is Authorised to Perform

Pursuant to section 33 (1) (d) (ii) of the Health and Disability Services Act 1993 I authorise the Transitional Health Authority (“the authority”) to carry out the following functions until the close of 30 June 1997:

• To enter an agreement with the Minister of Health on the outputs to be provided by the authority until the close of 30 June 1997.

• To put in place, for implementation on 1 July 1997, an organisational structure for the authority.

• To complete due diligence on the risks present in the business of the 4 existing RHAs including financial, contracting and legal risks.

• To put in place an inventory of ongoing and expected work, and to identify staff responsibility for that work.

• To put in place a management plan for the assets and liabilities to be transferred to the authority on 1 July 1997.

• To ensure that the legal obligations of the authority are met. One such obligation is the preparation of a statement of intent for the authority for the 1997–1998 year, containing the details and meeting the time frames provided for under the Public Finance Act 1989 and the Health and Disability Services Act 1993.

• To negotiate a funding agreement with the Minister of Health for the 1997–1998 year.

• To liaise with the existing 4 regional health authorities in carrying out the above functions.

Reappointment of Directors of Regional Health Authorities

Pursuant to section 35 (2) of the Health and Disability Services Act 1993, and in accordance with clause 3 (d) of the Second Schedule to that Act, I, reappoint each of the following persons as a director of the board of the Regional Health Authority indicated below, for the term specified in respect of that person.

Southern Regional Health Authority

Central Regional Health Authority

Midland Regional Health Authority

Northern Regional Health Authority

Tax Administration Act 1994

Notice of Product Ruling

1. This is a notice of a product ruling made under section 91F of the Tax Administration Act 1994.

2. Product ruling No. 97/36 was issued on 9 May 1997. It relates to the charging of transaction fees, and the application of sections CD 5, CE 1 (1) (a), and definitions within sections CF 2 (1) and OB 1 of the Income Tax Act 1994, as amended by the Taxation (Core Provisions) Act 1996.

3. Product ruling No. 97/36 is essentially the same as product ruling 95/10 issued on 28 November 1995, except that it takes into account the coming into force of the Taxation (Core Provisions) Act 1996, with effect from the 1997/98 income year.

4. A copy of the ruling may be obtained by writing to the Assistant General Manager (Adjudication & Rulings), National Office, Inland Revenue, P.O. Box 2198, Wellington.

Notice of Withdrawal of Product Ruling

1. This is a notice of a withdrawal of a product ruling made under section 91j of the Tax Administration Act 1994.

2. Product ruling 97/13 is hereby withdrawn.

3. Product ruling 97/13 originally applied to a wholesale superannuation fund for the period 14 February 1997 to 31 March 1997, and notice of its making appeared in the New Zealand Gazette of 27 February 1997.

4. Product ruling 97/13 is withdrawn on and from 15 May 1997.
