Fisheries Act 1983
Fisheries (Quota Aggregation Limit Exemption) Notice (No. 1) 1997 (No. F51)
Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission and after having regard to the provisions of section 28W (5) of the Fisheries Act 1983, hereby gives the following notice:

Title and commencement
(a) This notice may be cited as the Fisheries (Quota Aggregation Limit Exemption) Notice (No. 1) 1997.
(b) This notice shall come into effect on the day after its notification in the New Zealand Gazette. -
Interpretation
In this notice “Sanford Group” means Sanford Limited and those companies owned or controlled by Sanford Limited at the time of this notice and Wangaui Seafoods Limited and any of its subsidiary companies. -
Exemption to quota aggregation limit
As from the date that this notice comes into effect, the Sanford Group is permitted to hold quota and interest in quota in excess of the aggregation limits as provided in section 28W (1) of the Fisheries Act 1983, for the following species, up to the following limits:
(i) An aggregation limit of 45 percent of the combined Total Allowable Commercial Catch for each of the following species:
Alfonsino
Barracouta
Blue Warehou
Gemfish
Hake
Hoki
Jack Mackerel
Ling
Orange Roughy
Oreo Dories
Packhorse Rock Lobster
Red Cod
Silver Warehou
Squid
(ii) An aggregation limit of 20 percent of the Total Allowable Commercial Catch for paua in any one quota management area.
(iii) An aggregation limit of 20 percent of the combined Total Allowable Commercial Catch for bluenose.
(iv) An aggregation limit of 40 percent of the combined Total Allowable Commercial Catch for trevally.
(v) In any other case, 35 percent of the combined Total Allowable Commercial Catch for every stock of that species. -
Revocation
The following notices are hereby revoked:
The Fisheries (Quota Aggregation Limit Exemption) Notice 1994;
The Fisheries (Quota Aggregation Limit Exemption) Notice (No. 5) 1994;
The Fisheries (Quota Aggregation Limit Exemption) Notice 1994, Amendment No. 1
The Fisheries (Quota Aggregation Limit Exemption) Notice 1994, Amendment No. 2

Pursuant to section 28W (3) of the Fisheries Act 1983, the Minister of Fisheries, after consultation with the New Zealand Fishing Industry Board and the Treaty of Waitangi Fisheries Commission and after having regard to the provisions of section 28W (5) of the Fisheries Act 1983, hereby gives the following notice:

(b) This notice shall come into effect on the day after its notification in the New Zealand Gazette. -
Interpretation
In this notice, “Talley’s Group” means Talley’s Fisheries Limited, Amaltal Corporation Limited, Ocean Products Limited and McDonald and Brown Limited, and any companies owned or controlled by those companies. -
Exemption to quota aggregation limit
As from the date that this notice comes into effect, the Talley’s Group is permitted to hold quota and interest in quota in excess of the aggregation limits as provided in section 28W (1) of the Fisheries Act 1983, for the following species, up to a limit of 35 percent of the combined Total Allowable Commercial Catch:Barracouta
Elephant Fish
Flatfish
Gurnard
Snapper
Rig
Blue Warehou
School Shark

Pursuant to section 3 (3) (d) of the Fishing Industry Board Act 1963, I hereby give notice that I have appointed

and
Mr David Cunningham Sharp, managing director
to be members of the New Zealand Fishing Industry Board, each for terms of 3 years, from the 1st day of April 1997.
