Notice of Product Ruling

1. This is a notice of a product ruling made under section 91F of the Tax Administration Act 1994.

2. Product ruling No. 97/86 was issued on 28 November 1997. It relates to the G.S.T. implications of a sale and purchase agreement, and the definition of “going concern” in sections 2(1) and 11 (1) (c) of the Goods and Services Tax Act 1985.

3. A copy of the ruling may be obtained by writing to the Assistant General Manager (Adjudication & Rulings), National Office, Inland Revenue, P.O. Box 2198, Wellington.

Gaming and Lotteries Act 1977

Permission to Conduct Within New Zealand a Lottery Promoted Outside New Zealand

Pursuant to section 69 of the Gaming and Lotteries Act 1977, I, Jack Elder, Minister of Internal Affairs, hereby permit Micrografx Australia Pty Limited, to conduct within New Zealand, subject to the conditions specified in the Schedule to this notice, a lottery promoted outside New Zealand as a sales promotion scheme, to promote the sale of Micrografx graphics software packages, in particular the “Windows Draw 6” package.

Conditions

The permission given by this notice is subject to the following conditions, namely:

(1) Micrografx Australia Pty Limited, shall not conduct the sales promotion scheme in New Zealand after 22 December 1997;

(2) The results of the sales promotion scheme shall be published in the Sunday Star Times on 28 December 1997;

(3) Winners will be notified by certified mail;

(4) New Zealand winners shall not be subject to any extra cost when they claim their prizes;

(5) The chance of a New Zealand participant winning a prize shall be equal to that of an overseas participant.
