Public Works Act 1981

Road Realignment SH3 Mountain Road, Eltham and SH45 South Road, Omata

Pursuant to the Public Works Act 1981, the Minister of Lands, declares that:

(a) Pursuant to section 20 (1), agreements to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired for limited access road which, pursuant to section 88 (2) of the Transit New Zealand Act 1989, has become road, limited access road and State highway and to be vested in the Crown.

(b) Pursuant to sections 116(1), the areas of road described in the Second Schedule hereto, to be stopped.

(c) Pursuant to sections 117 (3) and 120 (1), both areas of stopped road described in the Second Schedule, now known as Sections 1 and 2, S.O. 13432, to be vested in Gavin Philip Taylor and Deborah Maree Taylor and amalgamated with the land in certificate of title K3/166, subject to memorandum of mortgage 443394.2, certificate 171536 and easement 437925.4.
