Declaring an Easement Over Land Acquired for River Control Purposes—Hill Road—Hawke’s Bay District

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Warranted Officer, Crown Property Services, Land Information New Zealand, Wellington, declares agreements to that effect having been entered into, the following easement in gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the New Zealand Gazette) vesting in The Hawke’s Bay Regional Council (called the grantee) on the date of publication hereof in the New Zealand Gazette.

The right to construct a river stopbank including full and free right in perpetuity for the grantee and its agents to do the following on and over the land described in the Schedule hereto (called the land):

(a) to enter the land and to pass and repass at all times with or without machinery or vehicles;

(b) modify, maintain or reconstruct the stopbank and to do all things necessary to maintain the same in an efficient state;

(c) to prohibit overgrazing of the land and destruction of vegetation by fire or cultivation;

(d) to prohibit the planting of trees or crops (other planting may be undertaken with the approval of the grantee; such approval shall not be unreasonably withheld) over the land;

(e) to prohibit the erection of any building on the land;

and

(f) to exercise the within rights in a manner reasonably necessary to serve the purpose of the work.

S.O. 10745 is lodged in the office of the Chief Surveyor at Napier.

Amending a Notice Amalgamating Stopped Road—Glengarry Elands Realignment, Hastings District

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Team Member, Crown Property Services, Land Information New Zealand, Napier, hereby amends the notice dated the 5th day of August 1997, published in the New Zealand Gazette on the 14th day of August 1997, No. 89, page 2138, under the heading “Stopped Road to be Amalgamated—State Highway No. 5, Glengarry Elands Realignment, Hastings District” by substituting “subject to mortgage 593355.3” in the recital, with “subject to first mortgage 593355.3 and second mortgage 563402.7”.
