Manawatu District Council

Public Works Act 1981

Notice of Intention to Take Land

Pursuant to Section 23 of the Public Works Act 1981

The Manawatu District Council, pursuant to the powers given to it under section 247F of the Local Government Act 1974, hereby gives notice under section 23 of the Public Works Act 1981 of its intention to take the land set out and described in the Schedule hereto for roading purposes.

The reason why the taking of the land is considered reasonably necessary is that the land will provide road access between portions of land currently separated by sections of legal road not yet formed and legalisation of such sections as public road will avoid continuing problems as to access, maintenance and control. Inquiries concerning this notice may be made to Mr P. J. McHardy, District Planner for The Manawatu District Council at his office at 135 Manchester Street, Feilding. Written objections to the taking of the said land must be lodged in writing with the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Private Bag, Postal Centre, Wellington, on or before the 30th day of October 1997.

The Schedule

Firstly, all that piece of land containing 4195 square metres, marked “A” and, secondly, all that piece of land containing 1619 square metres, marked “B”, both being part of Section 145, Town of Sandon, and being comprised in certificate of title 6/44, Wellington Registry, and shown on a survey office plan numbered 37594.

The registered proprietor of the said land as shown on the said title is Tapa Te Whata, an aboriginal native of Oroua.

A copy of the said survey office plan is available for inspection at the offices of the Manawatu District Council, 135 Manchester Street, Feilding.

Dated at Feilding this 22nd day of August 1997.

R. J. TITCOMBE, Principal Administrative Officer,
