Dumping and Countervailing Duties Act 1988

Notice of Initiation of Duty Reassessment for Plasterboard from Thailand

Pursuant to section 14 (6) of the Dumping and Countervailing Duties Act 1988 ("the Act"), and under delegated authority from the Secretary of Commerce, I hereby give notice that I have initiated a reassessment of the amount of anti-dumping duty in respect of imports into New Zealand of the goods described in the Schedule.

The purpose of the reassessment is to take account of the recent significant devaluation in the Thai baht, and to give effect to an agreement between Winstone Wallboard Limited and the Minister of Commerce, the Secretary of Commerce and the Ministry of Commerce. The reassessment will reassess the rate or amount of anti-dumping duty.

The reassessment initiated on 27 January 1997 with the purpose of ensuring that any changes in the elements between the non-injurious market price and the non-injurious FOB price which may have occurred, were incorporated into the anti-dumping remedy, has been terminated.

Description of Goods

Standard plasterboard with dimensions of a thickness falling between 8.75 mm to 10.25 mm and of any length or width.

The goods are currently classified under Tariff Item and Statistical Key 6809.11.00D of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Radiocommunications (Radio) Regulations 1993

Radiocommunications (Radio) Regulations (General Licence for 121.5 and 243.0 MHz Emergency Position Indicating Radio Beacons (EPIRBs)) Notice 1997

Pursuant to regulation 13 of the Radiocommunications (Radio) Regulations 1993, and acting under delegated authority from the Secretary of Commerce, I hereby give the following notice:

  1. Short title and commencement—(1) This notice may be cited as the Radiocommunications (Radio) Regulations (General Licence for 121.5 and 243.0 MHz emergency position indicating radio beacons (EPIRBs)) Notice 1997.

(2) This notice shall come into force on the 1st day of September 1997.

  1. General licence—A licence under regulation 13 of the Radiocommunications (Radio) Regulations 1993 is hereby granted for the installation, operation, and use of radio apparatus for the transmission of radio distress alerts at the frequencies specified in the First Schedule to this notice with the purpose of facilitating determination of the position of persons in search and rescue operations.

  2. Terms, conditions and restrictions—(1) The frequencies available for use under this licence shall be those specified in the First Schedule to this notice.

(2) This licence applies only to apparatus which complies with section 3 of Joint Australian/New Zealand Standard AS/NZS 4330:1995.

(3) This licence applies only to apparatus installed and operated for the purpose of transmission of radio distress alerts with the purpose of facilitating determination of the position of persons in search and rescue operations for which the Maritime Safety Authority of New Zealand does not require registration of a transmitted identity code.

(4) The technical conditions applying under this licence shall be those specified in the Second Schedule to this notice.

(5) The owner/user shall render the apparatus inoperable prior to its final disposal in a manner that will not compromise search and rescue operations.

  1. Period of Validity of Licence—This licence shall expire on the 31st day of January 1999.

Carrier Frequency Tolerance: ± 3 kHz at 121.5 MHz, ± 6 kHz at 243 MHz.

Maximum Power: 300 mW (-5 dBW) e.i.r.p.

Spurious Emissions: Must not exceed 75 dBµV/m measured 10 m from the antenna and 1.75m above the horizontal (-40 dBW e.i.r.p.).
