A PROCLAMATION
Pursuant to section 320 of the Maori Land Act 1993, and in accordance with a recommendation made by the Maori Land Court to the Minister of Transport, I, The Right Honourable Sir Michael Hardie Boys, Governor-General of New Zealand, declare that the land described in the Schedule hereto, shall be road.

South Auckland Land District
1786 square metres, more or less, being part Whakapoungakau 1B3H Block Roadway and being shown on Maori Land Plan 22310.
Given under the hand of His Excellency the Governor-General of New Zealand, and issued under the Seal of New Zealand, this 1st day of August 1996.

Notice of Intention to Take Land for Public Carpark Purposes
To: George Hart of Wellington, Esquire or his successors (address unknown—“the owner”);
And to: Any other person wishing to object to the proposal below.

Please note The Wellington City Council (“the council”) proposes to take under section 23 of the Public Works Act 1981, the interest of the owner as registered proprietor of the land described in the Schedule to this notice (“the land”).

The land is required for public carpark purposes in connection with the Thorndon Pool.

A plan of the land may be uplifted from David Carr, Property Officer, Property Department, Wellington City Council, Second Floor, Council Offices, 101 Wakefield Street (P.O. Box 2199), Wellington. Telephone No.: (04) 801 3228. Facsimile No.: (04) 801 3002.
Reasons for Taking Land
- The council considers it essential to take the owner’s interest in the land because it is required for public carpark purposes for the Thorndon Pool.
Right to Object

The owner’s interest in the land has not yet been taken.

The owner and any other person have a right to object to the taking of the owner’s interest in the land.

The owner or any other person wishing to object must send a written objection to the Registrar, Planning Tribunal, Tribunals Division, Department for Courts, P.O. Box 5027, Wellington, on or before the 20th day of September 1996.

If an objection is made, a public hearing of the objection will be held unless the objector gives written notice to the tribunal that the objector requires the hearing to be held in private.

If an objection is made:
(a) The objector will be advised of the time and place of the hearing; and
(b) The objector will have the right to appear and be heard personally or to be represented by a barrister and solicitor or any other person the objector authorises.
Right to Compensation
- This notice, and the right to object described above, relate to the taking of the owner’s interest in the land and not to his right to compensation. Under the Public Works Act 1981, the owner is entitled to full compensation, if his interest in the land is taken. If this compensation cannot be agreed between the council and the owner, it can be determined in separate proceedings before the Land Valuation Tribunal.

THIS NOTICE CONCERNS YOUR RIGHTS OVER THE LAND REFERRED TO. IF YOU ARE IN ANY DOUBT ABOUT ITS EFFECT YOU SHOULD OBTAIN LEGAL ADVICE IMMEDIATELY.
Do not delay.
That person with a registered right of way over the land will be served with a copy of this notice. It has a right to object.

An estate in fee simple in that piece of land containing 153 square metres, more or less, being part section 586, Town of Wellington, comprised in balance Deed Index 16/415 and being area “A” on Survey Office Plan 37525 (Wellington Registry), subject to a right of way in transfer 28387.
