Sub-Stratum Area in Waikato District Acquired for the Purposes of a Road subject to Easement

Pursuant to sections 20, 28 and 50 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the sub-stratum area described in the First Schedule hereto is hereby acquired for the purposes of a road and shall vest in The Waikato District Council (“the grantee”) on the date of publication hereof in the New Zealand Gazette, subject to the pedestrian accessway and right to convey electricity easement (“the easement”) described in the Second Schedule through the said sub-stratum area to be held appurtenant to the land in the Third Schedule.

Sub-stratum area comprising 50 square metres; as shown marked “C” on S.O. Plan 60014, lodged in the office of the Chief Surveyor at Hamilton.

Second Schedule

South Auckland Land District

(a) An easement granting the grantee its assigns and successors in title, agents, servants, workmen, licensees or invitees the right to pass and repass with or without implements and or machinery of any kind through the sub-stratum area or any part thereof to inspect, maintain, repair, lay or renew or re-lay all or any cables or any new cables and/or the duct or any part thereof as required by the grantee in connection with the Huntly Power Station or any ancillary purposes thereto.

(b) The grantee shall bear all the costs of maintenance and repair to the easement unless damage to it is caused by the action or negligence of the grantor, its servants, agents, invitees, workmen or licensees and in those circumstances such damage shall forthwith be repaired and made good by or at the expense of the grantor.

(c) In undertaking any of the maintenance or repair rights of the easement the grantee shall not cause the traffic flow across any affected portion of the overlying road to be interrupted unless the prior approval of the grantor is obtained in writing provided however the grantor shall not unreasonably withhold approval for the road to be closed for the purposes of maintenance or repair of the easement.

Road Stopped in Waikato District

Pursuant to section 116 and 117 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares the pieces of road described in the Schedule hereto, to be stopped and further declares that:

(i) Area “G”, now known as Section 12, S.O. 59700, shall be amalgamated with the land in certificate of title No. 45C/292, South Auckland Land Registry.

(ii) Area “H”, now known as Section 13, S.O. 59700, shall be amalgamated with the land in certificate of title No. 50A/939, South Auckland Land Registry.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for recreation reserve subject to the Reserves Act 1977, and shall vest in The Tauranga District Council, in trust, for such purpose, on the day of publication hereof in the New Zealand Gazette.
