District Court Judge Appointed

Pursuant to section 5 of the District Courts Act 1947 and section 5 (1) of the Family Courts Act 1980, the Administrator of the Government of New Zealand, has been pleased to appoint

Laurence John Ryan, barrister and solicitor of Auckland

to be a District Court Judge, to exercise civil and criminal jurisdiction within New Zealand, and to exercise the jurisdiction of the Family Courts.

Pursuant to sections 5 and 28B of the District Courts Act 1947, Her Excellency the Governor-General of New Zealand, has been pleased to appoint

Christopher John Harding, barrister and solicitor of Hamilton

to be a District Court Judge, to exercise civil and criminal jurisdiction within New Zealand, and to exercise the criminal jurisdiction of the District Courts under Part IIA of the District Courts Act 1947, at such place or places and for such period or periods only as the Chief District Court Judge may fix, pursuant to the said section 10A of the District Courts Act 1947, for a term of 12 months on and from the 28th day of April 1996.

Pursuant to section 10A of the District Courts Act 1947, the Administrator of the Government of New Zealand, has been pleased to appoint

John Russell Callander, retired District Court Judge

to be an Acting District Court Judge, to exercise civil and criminal jurisdiction, and to exercise the criminal jurisdiction of the District Courts under Part IIA of the District Courts Act 1947, at such place or places and for such period or periods only as the Chief District Court Judge may fix, pursuant to the said section 10A of the District Courts Act 1947, for a term of 12 months on and from the 28th day of April 1996.

ORDER IN COUNCIL

At Wellington this 25th day of March 1996

Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS, by virtue of certain provisions of the Maori Trust Boards Act 1955, an election of members of the Whakatohea Maori Trust Board was held in November 1993:

And whereas the following irregularities occurred at the election, namely,—

(a) The Board failed to comply with section 42 of the Maori Trust Boards Act 1955, which required the Board to cause a roll of beneficiaries to be prepared for the purposes of the election; and

(b) The Secretary of the Board failed to comply with section 46 of the Maori Trust Boards Act 1955, which required the Secretary of the Board to cause public notice to be given to beneficiaries of the Board of the fact that nominations were being called for election to membership of the Board for the ensuing term; and

(c) The Secretary of the Board failed to comply with section 46 of the Maori Trust Boards Act 1955, which required the Secretary of the Board to give to beneficiaries public notice of the latest date by which nominations must be lodged with the Secretary of the Board; and

(d) The Secretary of the Board failed to comply with section 51 of the Maori Trust Boards Act 1955, which required the Secretary of the Board, within one month after the latest date for the lodging of nominations, to post ballot papers to each beneficiary shown on the roll as entitled to vote at the election; and

(e) The Minister of Maori Affairs did not, as required by section 52 of the Maori Trust Boards Act 1955, appoint a Returning Officer for the purposes of the election:

And whereas these irregularities are such that it would not be proper or desirable to validate the election:

And whereas it is desirable to declare the election invalid and to provide for the holding of a fresh election of members of the Whakatohea Maori Trust Board:

NOW THEREFORE, pursuant to section 55A of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

  1. Title and commencement—(1) This order may be cited as the Whakatohea Maori Trust Board Order 1996.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. Election declared invalid—The election of members of the Whakatohea Maori Trust Board held in November 1993 is hereby declared to be invalid.

  2. Provision for fresh election—A fresh election of members of the Whakatohea Maori Trust shall be held in accordance with the following provisions:

(a) The Whakatohea Maori Trust Board shall forthwith cause to be prepared a roll of beneficiaries in accordance with section 42 of the Act;

(b) Not later than the 17th day of April 1996 the Secretary of the Whakatohea Maori Trust Board shall cause public notice to be given to the beneficiaries of the Board of the fact that nominations are called for election to membership of the Board for the ensuing term, the method of lodging nominations, and the latest date, as fixed by paragraph (c) of this clause, by which nominations must be lodged with the Secretary of the Whakatohea Maori Trust Board;

(c) Nominations shall be lodged with the Secretary of the Whakatohea Maori Trust Board not later than the 17th day of May 1996;

(d) Where an election is required, the Secretary of the Whakatohea Maori Trust Board shall, not later than
