Fisheries
Fisheries Act 1983
Notification of the Maketu Taiapure Proposal—Recommendations and Decisions—Notice (No. F23)
Pursuant to section 54g (9) (b) (i) of the Fisheries Act 1983, the Minister of Fisheries hereby publishes the report and recommendations of the tribunal concerning the Maketu taiapure proposal.
(a) Report and Recommendations of the Tribunal
In the matter of section 54g of the Fisheries Act 1983 and in the matter of a proposal by Te Ihu o te Waka ki Maketu to establish a Taiapure Local Fishery along the Bay of Plenty coast from Papamoa to Otamaraka.
Report and Recommendation to the Honourable Minister of Fisheries S 54 (G) (8) Fisheries Act 1983
This Tribunal sat at Rotorua on Tuesday 19th September 1995 to conduct an inquiry into all objections and submissions received pursuant to S 54g of the Fisheries Act 1983 concerning a proposal by Te Ihu O te Waka ki Maketu to establish the Maketu and Waihi Estuaries, and a coastal strip from Wairake to Otamaraka as a taiapure-local fishery. This has been agreed to in principle by the Minister of Fisheries, after consultation with the Minister of Maori Affairs and after having regard to the provisions of S 54a (3) of the Fisheries Act 1983. The area that is the subject of the proposal is as follows: The estuaries of Maketu and Little Waihi, and the foreshore and seabed out to 4–5 fathoms extending from Wairake to Otamaraka.
The inquiry heard submissions both in favour of and in opposition to the proposal. Predictably the Commercial Fisheries did not support the proposal: Mr Richard Cade for the New Zealand Federation of Commercial Fishermen (Incorporated) whilst making constructive and helpful points generally specifically objected to the size of area being dealt with raising again the question of whether the proposal concerned a “small and discrete” area as well the question of whether the water can totally be described as “estuarine” and “littoral” in terms of the legislation. The industry is concerned that the Taiapure may later be extended. Mr Cade also highlighted a discrepancy in the gazetted eastern boundary of the area and that in the application.
