Dumping and Countervailing Duties Act 1988

Initiation of Subsidy Investigation: Spaghetti in Tomato Sauce From Italy

Notice is hereby given that, acting pursuant to section 10(1) of the Dumping and Countervailing Duties Act 1988, and under delegated authority from the Secretary of Commerce, I have initiated an investigation to determine both the existence and effect of the alleged subsidisation of the goods described and from the country of origin specified in the Schedule to this notice, being satisfied that sufficient evidence has been provided that—

(a) The goods imported or intended to be imported into New Zealand are being subsidised; and

(b) By reason thereof material injury to an industry has been or is being caused or is threatened,—

and also being satisfied that the collective output of those New Zealand producers who have, in writing, expressed support for the application constitutes—

(a) Twenty-five percent or more of the total New Zealand production of like goods produced for domestic consumption (assessed during the most recent representative period, being not less than 6 months); and

(b) More than 50 percent of the total production of like goods produced for domestic consumption (as so assessed) by those New Zealand producers who have, in writing, expressed support for or opposition to the application.

The goods are currently classified under Tariff Item and Statistical Key 1902.30.01 09A of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

Confiscation of Motor Vehicle

Pursuant to section 84 of the Criminal Justice Act 1985, notice is hereby given that Geoffrey Francis Martin, concrete worker of 59 Omata Road, New Plymouth, was convicted on a charge of excess blood alcohol in the District Court at New Plymouth on the 21st day of February 1996.

An order for confiscation of a motorcar, namely a 1981 Datsun Sunny, registration No. JZ 7966, was made.

Confiscation of Motor Vehicle

Pursuant to section 84 of the Criminal Justice Act 1985, notice is hereby given that Evan Thomas Ramon Wrathall, unemployed of 61 Parris Street, Waitara, was convicted on two charges of driving whilst disqualified in the District Court at New Plymouth on the 5th day of March 1996.

An order for confiscation of a motorcycle, namely a 1989 Yamaha motorcycle, registration No. 88 RYR, was made.
