Amending a Notice Declaring Land Acquired for University Purposes in the City of Dunedin

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Business Manager, Lands and Property, Department of Survey and Land Information, Dunedin, hereby amends the notice dated the 11th day of January 1996 and published in the New Zealand Gazette, 18 January 1996, No. 3, page 115, declaring land acquired for university purposes in the City of Dunedin by omitting the following words “and shall vest in the Crown” and substituting them with the following words “and shall vest in the University of Otago”.

Land at St Anne’s Lagoon, Cheviot Acquired for Road

Pursuant to section 20(1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Regional Solicitor, Department of Survey and Land Information, Christchurch, declares that, agreements to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for road, which pursuant to section 60 (2) of the Transit New Zealand Act 1989, forms part of the State Highway No. 1 and shall vest in the Crown on the date of publication of this declaration in the New Zealand Gazette.

In the notice with the above heading published in the New Zealand Gazette, Issue No. 105, dated 9 July 1992, page 2395, amend the company that the land vested in, referred to as “Landcorp Management Services Limited” to read:

Landcorp Investments Limited.

Land Vested in Landcorp Investments Limited

Pursuant to section 24 (1) of the State-Owned Enterprises Act 1986, and to an authorisation dated 26 April 1995 from the Ministers of Finance and State-Owned Enterprises, the National Regulatory Manager, Department of Survey and Land Information, hereby gives notice as follows:

Notice

1. Title—This notice may be cited as the Landcorp Investments Limited Vesting Notice 1996 No. 4.

2. Application—(1) This notice applies to all the land described in the Schedule to this notice, saving and excepting:

   (a) The bed of any lake whose bed has an area of 8 hectares or more.

   (b) The bed of any river whose bed has an average width of 3 metres or more.

   (c) Any land covered and uncovered by the flow and ebb of the tide at mean spring tides.

   (2) In subclause (1) of this clause, the terms “bed”, “lake” and “river” have the meanings assigned to them by section 2 (1) of the Resource Management Act 1991.

3. Vesting—Subject to section 24 of the Conservation Act 1987, the land to which this notice applies shall vest for an estate in fee simple in Landcorp Investments Limited (a company duly incorporated under the Companies Act 1955, having its registered office at Wellington and being a State enterprise within the meaning of section 29 (1) of the State-Owned Enterprises Act 1986) on the 7th day of March 1996.

   (i) Together with the appurtenant rights (if any) described in the Schedule to this notice; but,

   (ii) Subject to the rights, interests and encumbrances (if any) to which it is described in the Schedule to this notice as being subject.
