Amending a Notice Acquiring Land for Road, Road Stopped and Vested—State Highway 2, Butchers Creek—Dannevirke

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Crown Property Officer, Land Information New Zealand, Napier, hereby amends the notice dated the 19th day of July 1996, published in the New Zealand Gazette of the 15th day of August 1996, No. 85, page 2270, under the heading "Land Acquired for Road, Road Stopped and Vested—State Highway 2, Butchers Creek—Dannevirke" by deleting the words "Land Acquired for Road" in the heading and substituting "Land Acquired for a Limited Access Road" and also deleting recital (a) and substituting the following:

"(a) Pursuant to section 114 (1) of the Public Works Act 1981 and section 88 (2) of the Transit New Zealand Act 1989, declares the land described in the First Schedule to be limited access road and has become road, limited access road and State highway and vested in the Crown."

Declaring Land to be Road, Road Stopped and Added to Adjoining Reserve in Rodney District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Regional Crown Property Services, Land Information New Zealand, Auckland, declares:

(a) Pursuant to section 114, the land described in the First Schedule to be road which shall vest in The Rodney District Council; and

(b) Pursuant to sections 116, 117 (3) (b) and 117 (7), the portion of road described in the Second Schedule to be stopped and when so stopped to be Crown land, subject to the Land Act 1948, and to be known as Section 1, S.O. Plan 68399 and to be added to the adjoining reserve described in the Third Schedule, and to be subject to the same reservations and trusts as the reserve to which it is added.

North Auckland Land District
100 square metres, being part Allotment 92, Village of Leigh; marked “A” on S.O. Plan 68399, lodged in the office of the Chief Surveyor at Auckland.

Second Schedule

North Auckland Land District
337 square metres, adjoining or passing through part Allotment 92, Village of Leigh; shown marked “B” on S.O. Plan 68399, lodged in the office of the Chief Surveyor at Auckland.

Third Schedule

North Auckland Land District
1923 square metres, being part Allotment 92, Village of Leigh. Balance Gazette notice published on 22 July 1880, No. 72, pages 1048 and 1049 (582625.1, North Auckland Land Registry), which, pursuant to section 6 of the Reserves and Other Lands Disposal Act 1978, is vested in The Rodney District Council, in trust as a local purpose reserve for the purpose of a public hall and library, subject to the Reserves Act 1977 and to section 6 of the Reserves and Other Lands Disposal Act 1978.

Land Acquired for Road (Blackbridge Road) in Rodney District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Regional Crown Property Services, Land Information New Zealand, Auckland, declares that, an agreement to that effect having been entered into, the land described in the Schedule is acquired, excluding therefrom firstly, all coal on or under the said land and rights to mine coal reserved to the Crown by section 168A of the Coal Mines Act 1925, and secondly, all minerals and rights to minerals reserved to the Crown by section 8 of the Mining Act 1971, for road and shall vest in The Rodney District Council on the date of publication in the New Zealand Gazette.
