ORDER IN COUNCIL

At Wellington this 16th day of September 1996

Present:

THE RIGHT HON. DON MCKINNON PRESIDING IN COUNCIL

Whereas,—

A. By virtue of certain provisions of the Maori Trust Boards Act 1955, an election of members of the Whanganui River Maori Trust Board should have been completed by the 30th day of April 1994, but was not completed until the 11th day of July 1996; and

B. Nominations for election to membership of the board should have been called for by the 30th day of December 1993, but those nominations were not called for until the 1st day of September 1995; and

C. The last date for the lodging of nominations of candidates for election to membership of the board was the 30th day of January 1994, but that date was instead fixed as the 30th day of November 1995; and

D. The last date by which the secretary of the board should have posted to each beneficiary shown on the roll of beneficiaries as entitled to vote at the election a printed ballot form, was the 28th day of February 1994, but the ballot forms were instead posted on the 12th day of June 1996; and

E. It is desirable to validate the election of members to the board on the 11th day of July 1996:

Now therefore, pursuant to section 55 of the Maori Trust Boards Act 1955, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby makes the following order.

Order

  1. Title and commencement—(1) This order may be cited as the Whanganui River Maori Trust Board Order 1996.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. Election validated—The election of members of the Whanganui River Maori Trust Board completed on the 11th day of July 1996 is hereby declared to be and to have always been valid notwithstanding that each of the following matters was not completed within the times prescribed by the relevant provisions of the Maori Trust Board Act 1955:

(a) The calling of nominations, in accordance with section 46 of the Act:

(b) The lodging of nominations with the secretary of the board, in accordance with section 47 of the Act:

(c) The posting of ballot papers, in accordance with section 51 of the Act:

(d) The return of ballot papers, in accordance with section 52 of the Act:

(e) The forwarding to the Chief Executive of the Ministry of Maori Development of the names of the persons elected, in accordance with section 49 of the Act.

Explanatory Note

This note is not part of the order, but is intended to indicate its general effect.

This order validates the election of members of the Whanganui River Maori Trust Board completed on 11 July 1996. The election should have been completed by 30 April 1994.

Transport

Harbours Act 1950

Sale of Greymouth Harbour Land

Pursuant to Part IV of the Harbours Act 1950, and to a delegation from the Minister of Transport, the Secretary of Transport, having obtained, pursuant to section 143A (3) of the Act, the concurrence of the Secretary to the Treasury under delegation from the Minister of Finance, hereby approves, pursuant to sections 143A (1) (a) and 143c (1) (b) (i) of the Act, the sale of land referred to in the Schedule below by The Grey District Council and specifies that this approval is effective from the date of this notice.

Schedule

(a) All that parcel of land containing 1012 square metres, more or less, being Section 116, Town of Dobson and being all the land comprised and described in certificate of title, Volume 5A, folio 1377 (Westland Registry).

(b) All that parcel of land containing 1012 square metres, more or less, being Section 117, Town of Dobson and being all the land comprised and described in certificate of title, Volume 5A, folio 1378 (Westland Registry).
