Civil Defence Act 1983

Declaration of a State of Local Civil Defence Emergency

Pursuant to section 52 of the Civil Defence Act 1983, I, Duncan Wishart Taylor, hereby declare a state of local civil defence emergency to be in force in the Ahuriri Ward of Waitaki District Civil Defence Organisation.

The state of local civil defence emergency shall come into force on the time and date of making of this declaration.

Time and Date of Declaration: 0.05 a.m., 14 December 1995.

Declaration Terminating State of Local Civil Defence Emergency

Pursuant to section 56 of the Civil Defence Act 1983, I, Duncan Wishart Taylor, hereby terminate the state of local civil defence emergency declared in respect of Ahuriri Ward of Waitaki District Civil Defence Organisation.

The termination of the state of local civil defence emergency shall take effect from the time of the making of the declaration.

Dumping and Countervailing Duties Act 1988

Termination of Subsidy Investigation: Sweetened Condensed Milk From Thailand

Notice is hereby given that, acting pursuant to section 11 of the Dumping and Countervailing Duties Act 1988, I have terminated a subsidy investigation in respect of sweetened condensed milk exported from Thailand (hereinafter referred to as “the subject goods”, as described in the Notice of Initiation of Dumping Investigation of 30 June 1995, and the New Zealand Gazette, 6 July 1995, page 1784).

Because I am satisfied, under section 11 (1) (c) of that Act that, as a result of investigations carried out, the imposition of a countervailing duty in respect of the subject goods would be inconsistent with New Zealand’s obligations as a party to the WTO Agreement, I have followed my statutory obligation to terminate the investigation.

Final Determination: G-Clamps From the United Kingdom

Notice is hereby given that, acting pursuant to section 13 of the Dumping and Countervailing Duties Act 1988 (hereinafter referred to as “the Act”), I have made a final determination that, in relation to the goods specified in the First Schedule to this notice (hereinafter referred to as “the subject goods”) imported or intended to be imported into New Zealand:

(a) The subject goods are being dumped; and

(b) By reason thereof material injury to the New Zealand G-clamp industry has been and is being caused.

Notice is also hereby given that, acting pursuant to sub-sections 14 (1), 14 (4) and 14 (5) of the Act, I have determined the amounts of anti-dumping duty to be imposed on the subject goods to be the amounts set out in the Second Schedule to this notice.

Description of Goods

SG (Spheroidal Graphite) ductile cast iron G-clamps, with a maximum clamping capacity from 2 to 9 inches.

The goods are currently classified under Tariff Item and Statistical Key 8205.70.01 00L of the Tariff of New Zealand, which classification is provided for convenience and Customs purposes only, the written description being dispositive.

SECOND SCHEDULE
Amount of Anti-Dumping Duty

The anti-dumping duty which is to be collected and paid on demand of the Collector in respect of the subject goods, and imported or intended to be imported into New Zealand from the United Kingdom, shall be equal to the amount by which the free-on-board value (being “Customs value” as defined in section 2 (1) of the Customs Act 1966) is less
