The rights and powers implied in and attaching to a right of way as set out in the Seventh Schedule to the Land Transfer Act 1952, under the heading “Right of Way” as if the same were fully set out herein and including the Ninth Schedule of the Property Law Act 1952, but the Crown shall have no obligation to make any reasonable contributions towards the maintenance of the right of way over the areas “E” and “C”.

Land Acquired in Connection With a Road

(State Highway No. 2) in Western Bay of Plenty District, Subject to an Easement

Pursuant to sections 20 and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, agreements to that effect having been entered into, the land described in the First Schedule hereto, is hereby acquired in connection with a road, and shall vest in the Crown on the date of publication hereof in the New Zealand Gazette, subject to a right of way easement in perpetuity described in the Second Schedule hereto, over the land described in the Third Schedule hereto, and to be held appurtenant to the land described in the Fourth Schedule hereto.

Pursuant to section 20 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto, is hereby acquired for cemetery purposes and shall vest in The Western Bay of Plenty District Council on the date of publication hereof in the New Zealand Gazette.
