Business Development Boards Act 1991

Code for Business Development Boards 1993 (No. 2), Amendment No. 3

To all Business Development Boards

Pursuant to section 7 (3) of the Business Development Boards Act 1991, the Minister of Business Development hereby gives the following notice:

Notice

  1. Title and commencement—(1) This notice may be cited as the Code for Business Development Boards 1993 (No. 2), Amendment No. 3, and shall be read with and deemed part of the Code for Business Development Boards 1993 (No. 2)* (referred to in this notice as the principal code).

(2) This notice shall come into effect on the 14th day of September 1995.

  1. Amendments to Principal Code—(1) Clause 2 of the principal code is hereby amended by revoking the definition of “Business Development Programme Schemes”.

(2) Clause 4 of the principal code is hereby amended by revoking paragraphs (d) and (e).

(3) Clause 6 of the principal code is hereby amended by revoking paragraph (b).

(4) The Schedule to the principal code is hereby revoked.

  1. Transition—(1) Notwithstanding clause 2 of this notice:

(a) All applications for grants under the Business Development Programme Schemes that are received by a board before the day on which this notice comes into effect; and

(b) All letters of intent to apply for grants under the Business Development Programme Schemes that are received by a board before the day on which this notice comes into effect,

shall be processed by the board as if this notice had not come into effect.

Notwithstanding clause (2) of this notice, every existing grant shall continue to have effect and shall continue to be administered by the boards as if this notice had not come into effect and as if the provisions of the principal code that applied to the grant before the coming into effect of this notice continued in force.

(3) Notwithstanding clause 2 of this notice, the rights and obligations attaching to existing grants shall continue in force as if this notice had not come into effect.

(4) Notwithstanding clause 2 of this notice:

(a) Where any person had a right of appeal under paragraph 13 of the Schedule to the principal code that had not expired as at the coming into effect of this notice; or

(b) An appeal had been lodged with the Minister but not determined before the coming into effect of this notice,

the principal code shall continue to apply to that right or to that appeal or implementing any decision arising out of the appeal, including the making of a grant in accordance with the principal code, as if this notice had not come into effect.

(5) For the purposes of clause 3 of this notice, the term “existing grant” includes all grants made under the provisions of the principal code, whether before or after the coming into effect of this notice.
