District Anglers Notice for Fish and Game Regions

Conservation Act 1987

Freshwater Fisheries Regulations 1983

Pursuant to section 26R (3) of the Conservation Act 1987 the Minister of Conservation approves the following District Anglers Notice, subject to the First, and Second, Schedules of this Notice, for the following Fish and Game Regions;

FIRST SCHEDULE

1. Interpretation
Words and expressions in this notice which are defined in the Conservation Act 1987 or the Freshwater Fisheries Regulations 1983, shall be so defined.

“Artificial fly” means any lure of feather, fur, wool or other material of any kind customarily used in the making of artificial flies, but does not include any lure in the tying of which lead or other weight has been incorporated unless the hook used in that lure does not exceed 14 mm in length (being the horizontal straight line distance from the rear of the eye, exclusive of the eye, to the rear of the bend) and the gape (being the distance from the point of the hook to the underside of the nearest part of the hook shank above the point) of the hook does not exceed 6 mm.

“Artificial minnow” includes spoonbait, any feather lure in the tying of which lead or other weight has been incorporated to facilitate the casting or sinking of the lure, and any lure which incorporates a spinning device or a device to impart a wobbling or irregular motion to the lure.

“Boat” includes any launch or other vessel; and also includes any canoe, punt, float tube or raft, and any aircraft or hovercraft on the surface of the water.

“Fishing” and “fish” in this Notice means ;
(a) The catching, taking, or harvesting of freshwater fish; and
(b) Includes—
(i) Any other activity that may reasonably be expected to result in the catching, taking, or harvesting of freshwater fish:
(ii) Any attempt to catch, take or harvest freshwater fish
(iii) Any operation in support of, or in preparation for, any activity described in this definition.

“Foulhook” means to take a fish with a hook otherwise than through the mouth.

“Lure” means any artificial or natural fly and any artificial minnow.

“Size” and/or “length” is the measurement from the tip of the snout to the tip of the tail.

“Sports fish” means those freshwater fish described in the First Schedule of the Freshwater Fisheries Regulations 1983, namely;
Brown Trout
Rainbow trout
American brook trout or char
Lake trout or char
Atlantic salmon
Quinnat or chinook salmon
Sockeye salmon
Perch
Tench
Rudd (Auckland/Waikato Fish & Game region only)

“All year” means a 12 month period commencing on 1 October and concluding on 30 September of the following year.

2. Authorised Tackle
2.1 No licence holder shall fish for sports fish except by using a rod and running line.
2.2 Nets:
2.2.1 When playing a sports fish a landing net may be used to secure or land that fish.
2.2.2 For keeping non-salmonid sports fish alive a keep net may be used in the water from which the fish was caught.
2.2.3 For taking indigenous fish for bait angling, a bait net may be used.
2.2.4 It shall be a defence for any licence holder charged with a breach of this clause if that licence holder proves that he or she was netting for indigenous fish in accordance with the provisions of any regulation or notices in force in that behalf.
2.3 No licence holder shall fish for sports fish, or have under their control, more than one assembled rod and running line.
2.4 No licence holder shall fish for sports fish unless within 15 metres of the rod being used and is able to see the rod.
2.5 No licence holder when fishing for sports fish shall use:
2.5.1 No more than 2 lures or baits
2.5.2 Any lead or weight (other than hooks as permitted elsewhere in this notice) attached below or as to hang below any lure or bait.
2.5.3 Any lure or bait having more than one hook or having a multiple hook, or any fixed assembly of hooks.
2.5.6 Any bait or lure treated with any medicinal or chemical preparation other than :
2.5.6.1 oil used solely to give buoyancy to an artificial fly.
2.5.6.2 a formalin or other preservative preparation for natural baits
2.5.7 Any hook which has a gap greater than 14 mm between the point and the nearest part of the shank.
2.5.8 The above restrictions of clause 2.5 shall not apply to licence holders fishing in the following Fish and Game Regions;
Wellington Fish and Game region

3. Prohibition on unauthorised fishing tackle, etc
The following items are prohibited when fishing for sports fish:
3.1 any paravane
3.2 any stroke hauling or foulhooking gear
3.3 any spear
3.4 any narcotic, poisonous substance or liquid injurious to fish.
