Unclaimed Property—Notice of Election by the Public Trustee to Become Manager Under the Public Trust Office Act 1957, Part V

Whereas:

1. The receivers of the Advisorcorp Group of Companies (in receivership) have advised the Public Trustee that they have ended the receivership and have had a final audit.

2. On the 29th day of August 1994, the Honourable Justice McGechan (in chambers) at Wellington, made an order entitled “Order permitting Plaintiffs to Make Further distribution to Contributors to the Mortgage Pool and Other Ancillary Orders” (M. No. 188/88).

3. That order permitted the receivers as plaintiffs to that application to make a certain further distribution of principal invested by contributors to the mortgage pool of the Advisorcorp Group of Companies (in receivership).

4. That order further provided that upon the Public Trustee electing to become manager of the same, the plaintiffs be permitted to pay to the Public Trustee all moneys held by the plaintiffs as a result of prior distributions which remained unclaimed together with all moneys which continued to be held by the plaintiffs and which were not claimed by contributors, (as a result of any future distribution), at the expiration of 6 months from the date of any such future distribution.

5. After due inquiry, it is not known where the owners of certain unclaimed moneys are or whether they are alive or dead.

6. Those moneys are described in the Schedule hereto by reference to the names and last-known addresses of the contributors to the mortgage pool of the Advisorcorp Group of Companies as provided to the Public Trustee by the former receivers to the Advisorcorp Group of Companies.

7. The gross value of the itemised property of each person entitled as owner (as estimated by the Public Trustee) does not exceed $4,000.

8. The Public Trustee is satisfied that in each case itemised in the Schedule below he should become manager of the property detailed in the Schedule under part V of the said Act.

Now therefore the Public Trustee in exercise of the authority conferred upon him by section 80(2) of the Public Trust Office Act 1957, hereby elects to be manager of the property detailed in the Schedule under part V of the said Act.
