Amending a Declaration Acquiring Land in Hamilton City for a Technical Institute

Pursuant to section 55 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton, hereby amends the declaration dated the 15th day of May 1995, and published in the New Zealand Gazette of 18 May 1995, No. 47, page 1217, acquiring land in Hamilton City for a technical institute by deleting “Lot 5” from the land sixthly described in the Schedule and substituting “Lot 4”.

Road Realignment in Waipa District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114 declares the land described in the First Schedule hereto to be road and vested in The Waipa District Council.

(b) Pursuant to sections 116 and 117 declares the piece of road described in the Second Schedule hereto to be stopped and that the said stopped road, now known as Section 4, S.O. 59904, shall be amalgamated with the land in certificate of title, Volume 516, folio 264, subject to memoranda of mortgage B. 023022.5 and H. 332598.2, South Auckland Land Registry.

First Schedule

800 square metres, situated in Block XIII, Hamilton Survey District, being part Allotments 135 and 136, Mangapiko Parish; as shown marked “D” on S.O. Plan 59904, lodged in the office of the Chief Surveyor at Hamilton.

Road Realignment in Waipa District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Assistant District Manager, Department of Survey and Land Information, Hamilton:

(a) Pursuant to section 114 declares the land described in the First Schedule hereto to be road and vested in The Waipa District Council.

(b) Pursuant to section 116 declares the pieces of road described in the Second Schedule hereto to be stopped.

(c) Pursuant to section 119 declares the land described in the Third Schedule hereto to be taken.

(d) Pursuant to sections 117 and 119 declares that:

(i) Areas “I” and “N”, now known together as Section 3, S.O. 58958, shall be amalgamated with the land in certificate of title No. 35A/616, subject to memorandum of mortgage B. 254446.5, South Auckland Land Registry.

(ii) Areas “H” and “M”, now known together as Section 4, S.O. 58958, shall be amalgamated with the land in certificate of title, Volume 813, folio 150, subject to memorandum of mortgage B. 097371.7 and to statutory land charge B. 097371.8, South Auckland Land Registry.

(iii) Area “G”, now known as Section 5, S.O. 58958, shall be amalgamated with the land in certificate of title No. 26A/689, subject to memoranda of mortgage H. 842905 and H. 300467A.4, South Auckland Land Registry.
