Declaration That a Marginal Strip is Not Required

Pursuant to section 24b of the Conservation Act 1987, the Minister of Conservation hereby declares that the marginal strip requirements set out in section 24 of the Act, shall not apply in the case of the disposition of the land in the Schedule hereto.

465 square metres, being Lot 2, D.P. 19241. All C.T. 4D/1392.

Land Act 1948

Reservation of Land

Pursuant to section 167 of the Land Act 1948, the Minister of Conservation, with the consent of the Minister of Lands and the Minister of Transport, hereby sets apart the area of foreshore described in the Schedule hereto, as a Government purpose (facilities associated with the protection of gannets) reserve, subject to the provisions of the Reserves Act 1977.

Schedule

All that area in the Hawke’s Bay Land District bounded by a line commencing at the common mean high water mark boundary point of Sections 2 and 3, Block III, Kidnapper Survey District (S.O. 8314) and proceeding generally westerly along the seaward boundary of the aforementioned Section 3, along the northern seaward boundary of Lot 2, Deeds Plan 915 to the intersection with the New Zealand Map Grid line of 2859000 east; thence north along the aforementioned grid line to its intersection with the mean low water springs mark; thence generally easterly along the mean low water springs mark to the intersection with the northerly production of the common boundary of the aforementioned Sections 2 and 3; thence proceeding south along the aforementioned produced line to the commencement point; excluding any islands or rocks contained within the nature reserve in New Zealand Gazette, 1983, page 2023, which may be within the above boundaries.

Reserves Act 1977

Classification of a Reserve

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, Janet Margaret Coates, Manager (Protection) of the Auckland Conservancy, Department of Conservation, hereby classifies the reserve described in the Schedule hereto, as a local purpose (kindergarten) reserve subject to the provisions of the said Act.

2726 square metres, more or less, being part Lot 113, D.P. 16446, situated in Block IV, Titirangi Survey District. All New Zealand Gazette, 1951, page 175.

Authorisation of the Exchange of a Part of a Reserve for Other Land

Pursuant to the Reserves Act 1977, and to a delegation from the Minister of Conservation, the Regional Conservator of the Nelson/Marlborough Conservancy of the Department of Conservation, hereby authorises the exchange of that part of the Wharehunga Bay Recreation Reserve described in the First Schedule for the land described in the Second Schedule hereto.

Marlborough Land District—Marlborough District

3.0010 hectares, more or less, being Lot 2, D.P. 5260. Part certificate of title 2B/768.

Second Schedule

Marlborough Land District—Marlborough District

10.7790 hectares, more or less, being Lots 1 and 3, D.P. 5260. Parts certificates of title 4B/399, 4B/400.
