Land, Leasehold Estate and Easement Acquired for V.H.F. Link Station Site in Block X, Taringatura Survey District
Pursuant to sections 20 (1) and 28 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Acting District Manager, Department of Survey and Land Information, Invercargill, declares that, agreements to that effect having been entered into, the land described in the First Schedule hereto, and the leasehold estate described in the Second Schedule hereto, are hereby acquired for a v.h.f. link station site, subject to the fencing condition described in the Fifth Schedule hereto and a right of way easement is hereby acquired over the land described in the Third Schedule hereto for a v.h.f. link station site, as an easement forever appurtenant to the land described in the First Schedule, subject to the terms and conditions set out in the Fourth Schedule hereto; and further declares that the said land and easements shall vest in the Crown on the date of publication hereof in the New Zealand Gazette.

Fourth Schedule

The Crown shall restore and make good any damage or injury caused to any part of the said land or to animals, trees or improvements thereon arising from the exercise of the rights hereby granted.

May at the Crown’s expense erect barrier fences, gates and noticeboards on the proposed site for the purpose of protecting any building, mast, cable, track and associated equipment from damage by persons with or without vehicle or by animals and for the purpose of informing or advising people who may be on the land PROVIDED ALWAYS that this power shall not be exercised without the prior consent of the registered proprietor of the land in the Second Schedule.

The full right of the Crown to a right of way easement conferring the rights contained in the Seventh Schedule of the Land Transfer Act 1952, over the land described in the Second Schedule hereto on the rights and conditions as hereinafter set forth.
(a) The full, free, uninterrupted and restricted right of liberty and privilege for the Crown and its invitees, agents and servants to enter on or over the land described in the Second Schedule hereto, with or without vehicles by day or by night for the purpose of obtaining physical access to the land described in the First Schedule thereto provided that:
(b) The Crown shall construct and maintain the right of way to the standard required for four wheel drive vehicular access and for keeping the land within the boundaries of the right of way clear of all noxious weeds. The registered proprietors of the land in the Second Schedule shall also have the use of the said right of way should they so desire.
(c) Provided always that all such users of the right of way shall ensure that:
(i) No access gates to the right of way are left open and the access gate off Chumming Road be kept locked.
(ii) No nuisance or annoyance shall be caused to the owner, or any adjoining owners or to the livestock depasturing on their respective properties.
(d) A DOUBLE gate to be installed at the Crown’s expense on the access track on the boundary of Section 486, Blocks V, IX and X, Taringatura Survey District and Lot 57A, D.P. 648, Taringatura Survey District. Such gate to be locked with two padlocks and a key of one to be provided free of cost to the lessees.
(e) A SINGLE gate to be installed at the Crown’s expense on the road boundary at the entrance of the access way to Lot 57A, D.P. 648, Taringatura Survey District. Such gate to be locked with three padlocks and a key of one to be provided free of cost to the lessees of Section 486, Blocks V, IX and X, Taringatura Survey District.
