Stopped Road in Whangarei District to be Vested

Pursuant to section 117 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Auckland, declares the part of stopped road described in the Schedule to be amalgamated with the land contained in certificate of title 94D/400, subject to all encumbrances registered on the certificate of title on the date of registration of this notice in the Land Registry Office.

2361 square metres, being Section 1 on S.O. Plan 67294, lodged in the office of the Chief Surveyor at Auckland.

Land Acquired for the Napier–Hastings Motorway—Omahu Road, Hastings District

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares the land described in the Schedule is acquired for the Napier–Hastings Motorway, and shall vest in the Crown on the date of publication in the New Zealand Gazette.

Right-of-Way Easement Acquired for Conservation Purposes in Hawke’s Bay

Pursuant to section 20 (1) of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Solicitor, Department of Survey and Land Information, Napier, declares, an agreement to that effect having been entered into, the easement described in the First Schedule is acquired over the land described in the Second Schedule for the purposes of access to land held for conservation purposes and shall vest in Her Majesty the Queen as an easement in gross on the date of publication in the New Zealand Gazette. The easement may be surrendered at any time by notice published in the New Zealand Gazette.

First Schedule

Right-of-Way easement

The full free and uninterrupted right for officers and employees of the Department of Conservation or any succeeding department with management responsibilities for the Ruahine Forest Park and for the public to pass over the land described in the Second Schedule (called the Right-of-Way) on the following terms and conditions:

Terms and Conditions:

  1. Use of the right-of-way by members of the public shall be limited as follows:

    (a) Access is to be on foot only
    (b) No vehicles (including bikes and motorbikes), horses, dogs or firearms are to be taken on to the right-of-way
    (c) No camping is permitted on the right-of-way
    (d) No fires are to be lit on the right-of-way
    (e) All persons wishing to use the right-of-way must first contact the registered proprietors or their authorised representatives
    (f) Access may be denied for farm management reasons including lambing and high fire risk.

  2. Officers of the Department of Conservation or any succeeding department with management responsibilities for the Ruahine Forest Park may use the right-of-way at any time on the following conditions:

    (a) Access may be on foot or by vehicle
    (b) The right-of-way shall be used only for management purposes associated with the Ruahine Forest Park or for wildlife management purposes
    (c) Prior notice shall be given to the registered proprietors or their authorised representatives.

Second Schedule

Hawke’s Bay Land District

Area Being
24.3317 ha Section 8, S.O. 5594, Block XI, Kuripapango Survey District. C.T. V1/192.

Road Realignment (Pahiatua Track) in the City of Palmerston North

Pursuant to the Public Works Act 1981, and to a delegation from the Minister of Lands, the Manager, Lands and Property, Department of Survey and Land Information, Wellington:

(a) Pursuant to section 114 (1), declares the land described in the First Schedule to this notice to be road and vested in The Palmerston North District Council.

(b) Pursuant to sections 116 (1), 117 and 120 (3), declares the portions of road described in the Second, Third, Fourth and Fifth Schedules to this notice to be stopped and declares that:

(i) The areas described in the Second Schedule shall be amalgamated with the land in certificate of title, No. 17A/18, subject to right of way created by Transfer 152740.5, statutory land charge No. 107936.1 and memoranda of mortgage 134246.1 and 412537.2.

(ii) The areas described in the Third Schedule shall be amalgamated with the land in certificate of title, No. 107/63, subject to memoranda of mortgage 966688.2 and 982498.2.

(iii) The areas described in the Fourth Schedule shall be amalgamated with the land in certificate of title, No. 329/188, subject to statutory land charge No. 107936.1 and memoranda of mortgage 134246.1 and 412537.2.

(iv) The areas described in the Fifth Schedule shall be amalgamated with the land in certificate of title,
