Notice Setting Apart Maori Freehold Land as a Maori Reservation

Pursuant to section 338 of Te Ture Whenua Maori Act 1993 and on the recommendation of the Maori Land Court the land described in the Schedule hereto is hereby set apart as a Maori reservation for the purpose of a recreational area, papa kainga and place of scenic and cultural interest and significance for the common use and benefit of the beneficial owners of the said land.

Schedule

South Auckland Land District

All that piece of land situated in Block VIII, Thames Survey District and described as follows:

Area Description
ha Kawakawa No. 1 Block as created by more or less partition order dated 12 July 1928.

Notice Setting Apart Maori Freehold Land as a Maori Reservation

Pursuant to section 338 of Te Ture Whenua Maori Act 1993 and on the recommendation of the Maori Land Court the Maori freehold land as described in the Schedule hereto is hereby set apart as a Maori reservation for the purposes of an urupa for the common use and benefit of the five hapu of Rangiwaea and Matakana namely, Tuwhiwhia, Tanuiarangi, Tauwhao and Te Ngare and to be known as Te Ahipuhihipuhi Maori Reserve.

All that piece of land situated in Blocks I and II, Tauranga Survey District and described as follows:

Being Kutaroha A (Urupa & Pa) Block as more or less created by partition order dated 14 March 1924.

At Wellington this 29th day of May 1995

Present:
The Right Hon. D. C. McKinnon presiding in Council

Pursuant to section 27D of the State-Owned Enterprises Act 1986, Her Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, and being satisfied that the land described in the Schedule to this order (being land transferred to the Electricity Corporation of New Zealand, a State enterprise, under section 23 of the State-Owned Enterprises Act 1986, and now held by that State enterprise) is Wahi Tapu, hereby makes the following order.

Order

  1. Title and commencement—(1) This order may be cited as the State-Owned Enterprises (Resumption of Wahi Tapu) Order 1995.

(2) This order shall come into force on the day after the date of its publication in the Gazette.

  1. Resumption of land—It is hereby declared that the land described in the Schedule to this order—

(a) Shall be resumed by the Crown on the 30th day of June 1995; and

(b) Shall, on the date of its resumption pursuant to this order, be no longer liable to resumption under section 27B of the State-Owned Enterprises Act 1986.

Schedule

Land to Be Resumed by the Crown

  1. All that parcel of land containing 1043 square metres, more or less, being Lot 62 on Deposited Plan 7991, situated in Block IV, Wairau Survey District, and being all the land comprised and described in certificate of title No. 5C/1093, Gisborne Registry, subject to:

(a) 187469.4 Transfer (easement in gross) granting a right to drain sewage over part marked “C” and “E” on Deposited Plan 7991 in favour of the Wairoa District Council (which easement is subject to (now) section 243 (a) of the Resource Management Act 1991);

(b) Section 11 of the Crown Minerals Act 1991;

(c) Part IVA of the Conservation Act 1987.

  1. All that parcel of land containing 5770 square metres, more or less, being Lot 78 on Deposited Plan 7991, situated in Block IV, Wairau Survey District, and being all the land comprised and described in certificate of title No. 5C/1107, Gisborne Registry, subject to:

(a) 187469.4 Transfer (easement in gross) granting a right to drain sewage over part marked “F” on Deposited Plan 7991 in favour of the Wairoa District Council (which easement is subject to (now) section 243 (a) of the Resource Management Act 1991);

(b) Section 11 of the Crown Minerals Act 1991;

(c) Part IVA of the Conservation Act 1987.

Explanatory Note

This note is not part of the order, but is intended to indicate its general effect.

This order, which is made under section 27D of the State-Owned Enterprises Act 1986, declares that the land described in the Schedule to this order (being land that is Wahi Tapu) shall be resumed by the Crown on the 30th day of June 1995 and shall, on the date of its resumption pursuant to this order, be no longer liable to resumption under section 27B of the State-Owned Enterprises Act 1986. That land, which is situated at Tuaí, is presently held by the Electricity Corporation of New Zealand, a State enterprise.
