Notice of Intention to Apply for Ministerial Approval of a Code of Practice Under the Health and Safety in Employment Act 1992—Professional Underwater Diving Operations

Pursuant to section 20 of the Health and Safety in Employment Act 1992, I, R. J. M. Hill, General Manager, Occupational and Health Service of the Department of Labour, in exercise of those powers delegated to me by the Secretary of Labour pursuant to section 40 of the State Sector Act 1988, hereby give notice of intention to apply to the Minister of Labour for his approval of a statement of preferred work practices or arrangements for health and safety in professional underwater diving operations as an "Approved Code of Practice", under the Act.

These preferred work practices or arrangements are designed to describe the general operational safety provisions as to the selection and use of diving equipment, diving operations at varying depths, operational procedures and other related operations for the protection of employees and for others health and safety.

I, Peter John Gresham, Minister of Social Welfare, hereby give you the following direction, pursuant to section 5 (2) of the Social Security Act 1964.

Amendments to Special Benefit Direction

I hereby direct that the Direction that I gave in relation to grants of special benefit dated the 28th day of March 1995 shall, after the date of this direction, be read as if the amendments specified in the Schedule to this Direction were incorporated within it.

Provision Amended Amendment
Part III, the definition of "Allowable costs": Delete paragraph (a):

Substitute:
"(a) The applicant’s actual accommodation costs including areas, provided that any arrears incurred while the person was in receipt of accommodation benefit, accommodation supplement, rent rebate allowance, or tenure protection allowance under the Act are not to be included; and"
Delete paragraph (c):
Substitute:
"(c) Disability related expenses, being expenses of a kind for which a disability allowance would be payable under section 69C of the Act (but not including any counselling costs in excess of the amount made available by way of disability allowance under the Act); and"
Schedule, column headings: | Delete "Standard Income":
Substitute "Standard Costs"
Schedule, clause 4 (c) | Delete "135.15"
Substitute "136.15".

Explanatory Note

This Direction amends the Direction given by the Minister dated 28 March 1995 relating to grants of special benefit under the Social Security Act 1964.

The amendments to the definition of Allowable costs correct two errors in the previous direction where any accommodation supplement, rent rebate allowance, tenure protection allowance, and disability allowance were counted twice in the assessment, as they are also included in the definition of Chargeable income by virtue of being benefits payable under Part I of the Act.

The amendments to the Schedule correct typographical errors.

The Direction of the Minister of Social Welfare relating to grants of special benefit of 28 March 1995 was published in New Zealand Gazette, 6 April 1995, No. 31, page 909.

Notice of Application for an International Air Service Licence

Pursuant to section 7 of the International Air Services Licensing Act 1947, notice is hereby given that Evergreen International Airlines, Inc of McMinnville, Oregon, United States of America, has applied for an International Air Service Licence to allow the airline to operate scheduled services for the carriage of cargo and mail between points in the United States of America and points in New Zealand.

Further details of this proposal may be obtained from the Secretary for Transport, Ministry of Transport, P.O. Box 3175, Wellington.

Any person or organisation wishing to make representations relating to this application must forward those representations in writing to reach me on or before 1 June 1995.
